Chapter 7.5. Hospital and Birthing Center Requirement RegardingUmbilical Cord Blood Donation

"Postnatal donation"
Sec. 1. As used in this chapter, "postnatal donation" has themeaning set forth in IC 12-31-1-2.

Written agreement between hospital or birthing center and thepublic umbilical cord blood bank
Sec. 2. Before a hospital or birthing center participates incollecting donations for the public umbilical cord blood bankestablished under IC 12-31-1-3(a), the hospital or birthing centershall enter into a written agreement with the public umbilical cordblood bank establishing the:
(1) conditions of the hospital's or birthing center's participation;and
(2) obligations of the hospital or birthing center;
in the umbilical cord blood donation initiative established underIC 12-31-2-2.

Requirement to offer option to patient to make a postnataldonation at no charge
Sec. 3. (a) Except as provided in section 4 of this chapter, aparticipating hospital or birthing center licensed under this articlemust offer a patient who delivers a newborn infant at theparticipating hospital or birthing center the option of making apostnatal donation following delivery of the newborn infant.
(b) A patient may not be charged for the collection or storage ofa donation or for a donation to the public umbilical cord blood bankestablished under IC 12-31-1-3(a).

No requirement for hospital, birthing center, or employee to collecta postnatal donation under specified circumstances
Sec. 4. (a) A participating hospital or birthing center is notrequired to collect a postnatal donation if either of the followingapplies:
(1) In the professional judgment of a physician licensed underIC 25-22.5 or a nurse midwife licensed under IC 25-23-1-13.1,the collection would threaten the health of the mother or theinfant.
(2) The postnatal donation is contrary to the moral principles orbeliefs of the religious denomination with which the
participating hospital or birthing center is affiliated.
(b) An employee of a participating hospital or birthing center isnot required to collect a postnatal donation if the postnatal donationis contrary to the religious principles or beliefs of the employee.

Cooperation with nonprofit corporation in maximizing postnataldonations
Sec. 5. A participating hospital or birthing center shall cooperatewith the nonprofit corporation (as defined in IC 12-31-1-1) inaccomplishing the public health goal of maximizing postnataldonations.

No requirement to enter into agreement with the public umbilicalcord blood bank; ability to enter into contracts with other persons
Sec. 6. A hospital or birthing center is not required to enter intoan agreement with the public umbilical cord blood bank and mayenter into contracts concerning postnatal tissue and postnatal fluidswith any person.
