    Chapter 12. Receipt by Certain Private or Municipal Hospitals ofCounty Financial Aid for Operation, Maintenance, and Enlargement;Prohibition Against Discrimination

Counties where chapter applies
    
Sec. 1. This chapter applies to a county that meets the followingconditions:
        (1) Has a hospital that meets the following conditions:
            (A) Is established at a cost of at least five hundred thousanddollars ($500,000).
            (B) Is:
                (i) owned and operated by a corporation organized underIC 23-17; or
                (ii) owned by a city within the county and operated, underthe terms and conditions of a written lease, by acorporation organized under IC 23-17.
            (C) The general corporate powers of the corporation areexercised by a board of directors that meets the followingconditions:
                (i) Is composed of residents of the county in which thehospital is located.
                (ii) Has one (1) member who is a member of or a persondesignated by the county executive of the county.
                (iii) May have one (1) member who is a licensedphysician.
                (iv) Is elected by the members of the corporation, whorepresent each organized church, religious association,labor union, and fraternal, charitable, military, and civicorganization in the county.
            (D) For which the revenue from the care of the hospital'spatients and other sources is insufficient to pay the cost ofthe operation, maintenance, repair, alteration, enlargement,furnishing, and equipment of the hospital.
        (2) Does not own and operate a hospital or provide adequatehospital care.

Conflict of interest of board members
    
Sec. 2. An individual is not prohibited from serving as a memberof the board of directors if the member:
        (1) has a pecuniary interest in; or
        (2) derives a profit from;
a contract or purchase connected with the hospital. However, themember shall disclose the interest or profit in writing to the boardand provide a copy to the state board of accounts. The member shallabstain from voting on any matter that affects the interest or profit.

County appropriation and tax levy
    
Sec. 3. The county fiscal body may annually make anappropriation from the county treasury to pay a part of the cost of theoperation, maintenance, repair, alteration, enlargement, furnishing,and equipment of the hospital and for that purpose may annually levya special tax, in an amount to be fixed by the county fiscal body, onall taxable property located in the county.

Conditions of operation of recipient hospitals
    
Sec. 4. A hospital that receives financial assistance under thissection:
        (1) shall be operated for the benefit of all the residents of thecounty without discrimination;
        (2) must have reasonable rates and charges for service thatapply to all residents of the county; and
        (3) may extend the privileges and use of the hospital to personsresiding outside of the county on the terms and conditions theboard of directors of the corporation that owns or leases thehospital prescribes.

Eligibility of organization operating hospital
    
Sec. 5. An organized church, a religious association, a laborunion, and a fraternal, charitable, military, and civic organizationreferred to in section 1 of this chapter is one that meets the followingconditions:
        (1) Has adopted bylaws.
        (2) A majority of the members are at least twenty-one (21) yearsof age.
        (3) Has an elected presiding officer and secretary.
        (4) Had at least four (4) regular meetings in the county duringthe preceding calendar year.
        (5) Has a regular meeting place.

Submission of requests for aid
    
Sec. 6. A hospital corporation entitled under this chapter toreceive aid shall, within the time fixed for townships to file budgets,file with the auditor of the county a written request addressed to thecounty fiscal body for aid. The request must include a statement ofthe facts that entitle the hospital corporation to aid.

Payment of tax collections    Sec. 7. The taxes collected under this chapter shall be paid overto the hospital corporation without further action or proceeding whengeneral taxes are paid over and distributed by the county.

Assistance to more than one hospital corporation
    
Sec. 8. The county fiscal body may grant the aid provided undersection 3 of this chapter to as many hospital corporations in thecounty as may be entitled to aid.
