Chapter 13. County Financial Aid to Benevolent Hospitals

Application of chapter
Sec. 1. This chapter applies to a nonprofit hospital corporationthat meets the following conditions:
(1) Is established in or within one (1) mile of a city.
(2) Has articles of incorporation or a constitution or bylaws thatprovide the following:
(A) The incorporators shall be the first board of trustees,which is the sole governing board, and which electssuccessors at stated periods from reputable citizens of thecity and vicinity who meet the following conditions:
(i) Include one (1) licensed physician.
(ii) Are persons interested in the benevolent work of thehospital, chosen without reference to political or sectarianinfluence.
(iii) Receive no compensation for services.
(B) The corporation's general corporate powers will beexercised by a board of directors, who meet the followingconditions:
(i) May include one (1) licensed physician.
(ii) Are residents of the county in which the hospital islocated and elected by a board of electors consisting ofrepresentatives from each organized church, religiousassociation, labor union and fraternal, charitable, military,patriotic, and civic organization in the city.
(3) The revenue derived from the care of persons able to pay forservices and from all other sources is expended in themaintenance of the hospital and for the care of persons who areunable to pay, to the extent of the hospital's ability to assist, sothat revenues are insufficient to support and maintain thehospital and enable the hospital to supply the demand forhospital care and nursing in the city and community.

Conflicts of interest of board members
Sec. 2. An individual is not prohibited from serving as a memberof the governing board if the member:
(1) has a pecuniary interest in; or
(2) derives a profit from;
a contract or purchase connected with the hospital. However, themember shall disclose the interest or profit in writing to the boardand provide a copy to the state board of accounts. The member shallabstain from voting on any matter that affects that interest or profit.

Appropriations to aid hospital; authorization
Sec. 3. If there is no other city or public hospital in the county, thecounty may appropriate money to aid the hospital for the benefit ofthe people of the county. The county executive may contract with thegoverning board of the hospital for the nursing and care of the poorof the county who are sick, injured, or disabled, upon terms that thecounty officers determine to be just and proper.
