Chapter 3. Tax Levies and Appropriations for HospitalAssociations by Third Class Cities
IC 16-23-3-1
Application of chapter
Sec. 1. This chapter applies to a third class city that meets thefollowing conditions:
(1) Has no hospital facilities for the third class city's citizens.
(2) Has a nonprofit hospital corporation that meets thefollowing conditions:
(A) Has the hospital corporation's principal office and placeof business designated in the hospital corporation's articlesof incorporation as located in, or within one (1) mile of thelimits of, the city.
(B) Desires to construct or has constructed in the city, orwithin one (1) mile of the city, a nonprofit hospital to beoperated for charitable purposes.
(C) Has a governing board that meets the followingconditions:
(i) Manages the construction, maintenance, and operationof the hospital.
(ii) Is entirely nonsectarian and nonpolitical.

Construction and equipment of facilities; payment of obligations;contracts
Sec. 2. The city fiscal body may do the following:
(1) Appropriate money to aid in the construction and equipmentof hospital buildings and purchase of suitable grounds, in anamount not more than the amount provided for the purchase andconstruction by the nonprofit hospital corporation under section1 of this chapter.
(2) Appropriate money to pay the obligations of the nonprofithospital corporation under section 1 of this chapter for thepurchase of grounds and equipment for and the construction ofthe hospital.
(3) Enter into a contract, upon terms the city fiscal bodyconsiders advantageous to the citizens of the city, with thenonprofit hospital corporation under section 1 of this chapterand donors of a fund for the following purposes:
(A) To purchase grounds and construct and equip thehospital building.
(B) To name the hospital.
(C) To hold title to the hospital building and grounds.
(D) To receive donations and determine the terms uponwhich donations may be accepted.

Defrayment of deficiencies
Sec. 3. If the city has provided assistance to the nonprofitcorporation under section 2 of this chapter and the revenues derivedfrom patient fees in any one (1) year and all other income of theassociation are not sufficient to maintain the hospital and grounds,the city may appropriate and pay to the nonprofit hospitalcorporation annually a sufficient amount to defray the deficiency.

Hospital admittance
Sec. 4. A hospital described in this chapter must be open to all ofthe following:
(1) Persons on reasonable terms.
(2) Physicians on reasonable terms who desire to place patientsin the hospital.
(3) Employees of the city, without charge, who are injured inthe course of employment.
(4) Poor and indigent persons on reasonable rates to be paid bythe proper officers having charge of the care of those persons.

Bonds; tax levy
Sec. 5. (a) The city fiscal body may issue and sell bonds of thecity, under the regulations followed for the issuance and sale ofbonds for the construction of other city buildings, to provide moneyto do the following:
(1) Aid in the purchase, equipment, and construction of thehospital buildings and grounds.
(2) Pay the obligations of the hospital association.
(b) The fiscal body may also levy and collect taxes to pay andsatisfy bonds when due.

Maintenance tax
Sec. 6. The city fiscal body may annually levy and collect a tax ofnot more than two and sixty-seven hundredths cents ($0.0267) oneach one hundred dollars ($100) of the taxable property in the city toprovide money to aid in the maintenance of the hospital as providedin this chapter.
