    Chapter 7. Disclosure Requirements

Disclosure document presented to potential patients
    
Sec. 1. Each hospice program licensed or approved under thisarticle shall prepare and update as necessary a disclosure documentto be presented to each potential patient of the hospice program.

Contents of disclosure document
    
Sec. 2. The disclosure document required under section 1 of thischapter must contain at least the following:
        (1) A description of all hospice services provided by thehospice program, including the:
            (A) types of nursing services;
            (B) other services;
            (C) specific services available during the progressive stagesof the terminal illness and thereafter; and
            (D) a statement that the extent of hospice services andsupplies are dispensed based on the hospice programpatient's individual needs as determined by theinterdisciplinary team.
        (2) An explanation of the hospice program's internal complaintresolution process.
        (3) A statement that the hospice program patient has the right toparticipate in the planning of the patient's care.
        (4) A statement that a hospice program patient may refuse anycomponent of hospice services offered by the hospice program.
        (5) A statement that a hospice employee may provide suppliesto a:
            (A) hospice program patient; or
            (B) hospice program patient's family;
        in addition to the supplies provided by the hospice program, butthe employee may only be reimbursed for the supplies byproviding a written receipt to the hospice program patient or thehospice program patient's family.
        (6) A statement that the hospice program patient may requestthe hospice program to provide, on a monthly basis, an itemizedstatement of services and supplies delivered to the patient, assubmitted to the patient's payor.
        (7) The toll free number established by the state departmentunder IC 16-25-5-4 to receive complaints from hospice programpatients and the family members of hospice program patientsregarding the hospice program.

Plan of care    Sec. 3. The hospice program must:
        (1) include in the plan of care the professional disciplines thatwill furnish the care to the patient and the frequency of visitsproposed to be furnished; and
        (2) advise the hospice program patient of any change in the planof care.
