Chapter 3.5. Emergency Medical Dispatch

Definitions; applicability
Sec. 1. (a) The definitions in this section apply throughout thischapter.
(b) "Emergency medical dispatching" means the reception,evaluation, processing, and provision of dispatch life support,management of requests for emergency medical assistance, andparticipation in ongoing evaluation and improvement of theemergency medical dispatch process. This process includesidentifying the nature of the request, prioritizing the severity of therequest, dispatching the necessary resources, providing medical aidand safety instructions to the callers, and coordinating the respondingresources as needed, but does not include call routing itself.
(c) "Emergency medical dispatch agency" means any person thatprovides emergency medical dispatching for emergency medicalassistance that is certified under this chapter.

Exclusion
Sec. 2. This chapter does not apply to the following:
(1) A person who solely dispatches prescheduled emergencymedical transports.
(2) A person who provides emergency medical dispatchingduring a major catastrophe or disaster with which individuals ordispatch agencies certified to provide emergency medicaldispatching are unable to cope.

Certification requirement
Sec. 3. After December 31, 2009, a person may not furnish,operate, conduct, maintain, or advertise services as an emergencymedical dispatcher or otherwise be engaged as an emergency medicaldispatch agency unless certified by the commission as an emergencymedical dispatch agency.

Certification requirements for emergency medical dispatchagencies; expiration; operating standards; requirements; report tocommission
Sec. 5. (a) To be certified as an emergency medical dispatchagency, a person must:
(1) meet the standards established by the commission; and
(2) pay the fee established by the commission.
(b) An emergency medical dispatch agency certificate expires onthe expiration date established when it is issued, which must be atleast two (2) years after the date of its issuance. To renew acertificate, an emergency medical dispatch agency must:
(1) meet the renewal requirements established by thecommission; and
(2) pay the fee established by the commission.
(c) The emergency medical dispatch agency must be operated ina safe, efficient, and effective manner in accordance withcommission approved standards that include the followingrequirements:
(1) Before functioning alone in an online capacity, all personnelproviding emergency medical dispatch services must becertified as emergency medical dispatchers through a trainingprogram that is:
(A) approved by the commission; and
(B) used by the department.
(2) The protocols, procedures, standards, and policies used byan emergency medical dispatch agency to dispatch emergencymedical aid must comply with the requirements established bythe commission.
(d) The commission may require the submission of periodicreports from an emergency medical dispatch agency. The emergencymedical dispatch agency must submit the reports in the manner andwith the frequency required by the commission.
(e) An emergency medical dispatch agency shall report to thecommission whenever an action occurs that may justify therevocation or suspension of a certificate issued by the commission.

Rules
Sec. 7. The commission shall adopt rules under IC 4-22-2 toimplement this chapter.
