Chapter 18. Prevention and Treatment Programs: HemophiliaCare and Treatment Program

Hemophilia
Sec. 2. As used in this chapter, "hemophilia" means a bleedingtendency resulting from a genetically determined deficiency factorin the blood.

Care and treatment programs
Sec. 3. (a) The state department shall establish a program for thecare and treatment of persons suffering from hemophilia.
(b) The program established under subsection (a) shall assistpersons who:
(1) require continuing treatment with blood and bloodderivatives to avoid crippling, extensive hospitalization, andother effects associated with the critical, chronic bleedingcondition; and
(2) are unable to pay for the entire cost of such services on acontinuing basis despite the existence of various types ofhospital medical insurance coverage, Medicare, Medicaid, othergovernment assistance programs, and private charitableassistance programs.

Development of care and treatment programs
Sec. 5. The state department may do the following:
(1) Develop standards for determining eligibility for care andtreatment under the hemophilia program established under thischapter.
(2) Assist in the development and expansion of programs for thecare and treatment of persons suffering from hemophilia,including the following:
(A) Self-administration.
(B) Prevention.
(C) Home care.
(D) Other medical and dental procedures and techniquesdesigned to provide maximum control over bleeding
episodes typical of the condition.
(3) Extend financial assistance to persons suffering fromhemophilia in obtaining blood, blood derivatives andconcentrates, and other efficacious agents for use in hospital,medical, and dental facilities and at home or participate in thecost of blood processing to the extent that such support willfacilitate the supplying of blood, blood derivatives andconcentrates, and other efficacious agents to hemophiliacpatients at an economical cost, thus increasing the effectivenessof the money appropriated to carry out this chapter.
(4) Adopt rules necessary to carry out this chapter.

Violations
Sec. 6. (a) Except as otherwise provided, a person who recklesslyviolates or fails to comply with this chapter commits a Class Bmisdemeanor.
(b) Each day a violation continues constitutes a separate offense.
