Chapter 3. Communicable Disease: Compilation of Data forPurposes of Preventing Spread of Disease

Rules; procedures; notice
Sec. 1. (a) The state department may adopt rules under IC 4-22-2concerning the compilation for statistical purposes of informationcollected under IC 16-41-2.
(b) The state department shall adopt procedures to gather,monitor, and tabulate case reports of incidents involving dangerouscommunicable diseases or unnatural outbreaks of diseases known orsuspected to be used as weapons. The state department shallspecifically engage in medical surveillance, tabulation, and reportingof confirmed or suspected cases set forth by the Centers for DiseaseControl and Prevention of the United States Department of Healthand Human Services and the United States Public Health Service ofthe United States Department of Health and Human Services.
(c) The state department shall notify the:
(1) department of homeland security;
(2) Indiana State Police; and
(3) county health department and local law enforcement agencyhaving jurisdiction of each unnatural outbreak or reported casedescribed in subsection (b);
as soon as possible after the state department receives a report undersubsection (b). Notification under this subsection must be made notmore than twenty-four (24) hours after receiving a report.

Duties of state department of health
Sec. 2. (a) The state department shall tabulate all case reports oftuberculosis and other dangerous communicable diseases reportedunder this article or under rules adopted under this article. The statedepartment shall determine the prevalence and distribution of diseasein Indiana and devise methods for restricting and controlling disease.
(b) The state department shall include the information on theprevalence and distribution of tuberculosis and other dangerouscommunicable diseases in the state department's annual report.
(c) The state department shall disseminate the informationprepared under this section.
(d) The state department shall develop capabilities and proceduresto perform preliminary analysis and identification in as close to a realtime basis as is scientifically possible of unknown bacterialsubstances that have been or may be employed as a weapon. Thestate department shall implement the developed capacity andprocedures immediately after the state department achieves a LevelB capability as determined by the Centers for Disease Control andPrevention of the United States Department of Health and Human
Services and the United States Public Health Service of the UnitedStates Department of Health and Human Services.

Violations
Sec. 3. (a) Except as otherwise provided, a person who recklesslyviolates or fails to comply with this chapter commits a Class Bmisdemeanor.
(b) Each day a violation continues constitutes a separate offense.
