    Chapter 42.1. Registration of Out-of-State Mobile Health CareEntities

"Health care entity"
    
Sec. 1. As used in this chapter, "health care entity" means anentity that:
        (1) is registered or licensed as a health care entity under thelaws of another state, a foreign country, or a province in aforeign country; and
        (2) provides health care services, including the performance ofhealth care tests, in a mobile facility or temporary location fora short period of time.

Registry maintained
    
Sec. 2. The state department shall maintain a registry of healthcare entities that apply for and meet the registration requirements ofthis chapter.

Required registry information
    
Sec. 3. The registry maintained under section 2 of this chaptermust include:
        (1) the information required under section 5(6) of this chapterfor each registered health care entity; and
        (2) the date that the health care entity registered with the statedepartment under this chapter.

Certificate of registration
    
Sec. 4. The state department shall issue a certificate of registrationto a health care entity that applies for registration and meets therequirements of this chapter.

Application information
    
Sec. 5. A health care entity applying for registration under thischapter must disclose the following:
        (1) The types of health care services that the health care entitywill provide in Indiana.
        (2) The names of any employees who are currently in goodstanding licensed, certified, or registered in a health careprofession in:
            (A) Indiana; or            (B) any other state;
        and a copy of each employee's license, certification, orregistration.
        (3) Any health care services that are to be provided under acontract between the health care entity and a person that islicensed, certified, or registered in Indiana to provide healthcare services.
        (4) The types of:
            (A) health care services that the health care entity willperform;
            (B) health care tests that the health care entity will perform;and
            (C) equipment that the health care entity will use.
        (5) The manner in which test results and recommendations forhealth care based on the test results will be disclosed topatients.
        (6) The health care entity's name, address, and telephonenumber and the name of any company that is affiliated with thehealth care entity.

Display of certificate
    
Sec. 6. A registered health care entity that is issued a certificateof registration under this chapter shall display the certificate ofregistration in a conspicuous place in sight of a consumer of thehealth care entity.

Expiration of certificate
    
Sec. 7. A certificate of registration issued under this chapterexpires one (1) calendar year after its issuance.

Required registration
    
Sec. 8. A health care entity may not provide services in Indianauntil the health care entity is registered with the state departmentunder this chapter.

Requirements
    
Sec. 9. The registration of a health care entity under this chapterdoes not exempt:
        (1) a health care professional from the licensure, certification,and registration requirements of IC 25; or
        (2) a health care service from the regulation requirements ofIC 16 or IC 25.As added by P.L.3-2008, SEC.112.

Rules
    
Sec. 10. The state department shall adopt rules under IC 4-22-2necessary to implement this chapter, including rules specifyingregistration renewal procedures.
