    Chapter 17. Food: Regulation of Sodium Saccharin, N.F.

Permitted activities
    Sec. 1. Notwithstanding any rule or regulation adopted by thefederal Food and Drug Administration concerning sodium saccharin,N.F., the chemical substance sodium saccharin, N.F. may bemanufactured, distributed, sold, and used within Indiana.

Powers of board of pharmacy and department of health
    Sec. 2. (a) The Indiana board of pharmacy and the statedepartment may not prohibit the manufacture, distribution, sale, oruse of sodium saccharin, N.F. within Indiana, either as a componentof any other substance produced within Indiana or as a separateproduct.
    (b) The state department may regulate the manufacture,distribution, sale, or use of sodium saccharin, N.F. only to ensure thatthe substance is not adulterated or misbranded within the meaning ofIC 16-42-2 and IC 16-42-3.

    Sec. 3. A person who is engaged in the manufacture, sale,distribution, or use of sodium saccharin, N.F. may not be prohibitedfrom the manufacture, sale, distribution, or use of sodium saccharin,N.F. within Indiana.
