    Chapter 18. Food: Transportation of Food in Trucks Used toTransport Solid Waste

"Solid waste" defined
    
Sec. 1. (a) As used in this chapter and except as provided insubsection (b), "solid waste" has the meaning set forth inIC 13-11-2-205(a).
    (b) The term does not include waste that is regulated under thefollowing:
        (1) IC 13-22-1 through IC 13-22-8.
        (2) IC 13-22-11.5.
        (3) IC 13-22-13 through IC 13-22-14.

Sec. 2. As used in this chapter, "truck" has the meaning set forthin IC 9-13-2-188(a).

Trucks transporting both solid waste and food; time limitations
    
Sec. 3. Except as provided in section 4 of this chapter, a truck thatis used to transport a quantity of more than four thousand (4,000)pounds of solid waste to a landfill, an incinerator, or a transferstation may not be used to transport food until at least fifteen (15)days after transporting the solid waste.

Sanitizing trucks transporting both solid waste and food
    
Sec. 4. A truck that is used to transport a quantity of more thanfour thousand (4,000) pounds of solid waste to a landfill, anincinerator, or a transfer station may be used to transport food lessthan fifteen (15) days after transporting the solid waste if the truck,after transporting the solid waste, has been properly sanitizedaccording to rules adopted under section 5 of this chapter.

Rules
    
Sec. 5. The state department may adopt rules under IC 4-22-2 toimplement this chapter. The rules adopted under this section may dothe following:
        (1) Require documentation on the transportation of food inIndiana that would disclose violations of section 3 of thischapter.        (2) Establish procedures for the proper sanitizing of trucks forthe purposes of this chapter.

Civil penalties
    
Sec. 6. A person who violates section 3 of this chapter is subjectto civil penalties under IC 16-42-1-17.

Violations
    
Sec. 7. (a) Except as otherwise provided, a person who recklesslyviolates or fails to comply with this chapter commits a Class Bmisdemeanor.
    (b) Each day a violation continues constitutes a separate offense.
