    Chapter 6. Interagency State Council on Black and MinorityHealth

Council
    
Sec. 1. As used in this chapter, "council" refers to the interagencystate council on black and minority health.

Minority
    
Sec. 2. As used in this chapter, "minority" means an individualidentified as any of the following:
        (1) Black or African-American.
        (2) Hispanic or Latino.
        (3) Asian.
        (4) American Indian.
        (5) Alaska Native.
        (6) Native Hawaiian and other Pacific Islander.

Establishment
    
Sec. 3. The state department shall establish the interagency statecouncil on black and minority health.

Membership
    
Sec. 4. (a) The council consists of the following twenty-one (21)members:
        (1) Two (2) members of the house of representatives fromdifferent political parties appointed by the speaker of the houseof representatives.
        (2) Two (2) members of the senate from different politicalparties appointed by the president pro tempore of the senate.
        (3) The governor or the governor's designee.
        (4) The state health commissioner or the commissioner'sdesignee.
        (5) The director of the division of family resources or thedirector's designee.
        (6) The director of the office of Medicaid policy and planningor the director's designee.
        (7) The director of the division of mental health and addictionor the director's designee.
        (8) The commissioner of the department of correction or thecommissioner's designee.
        (9) One (1) representative of a local health department

appointed by the governor.
        (10) One (1) representative of a public health care facilityappointed by the governor.
        (11) One (1) psychologist appointed by the governor who:
            (A) is licensed to practice psychology in Indiana; and
            (B) has knowledge and experience in the special healthneeds of minorities.
        (12) One (1) member appointed by the governor based on therecommendation of the Indiana State Medical Association.
        (13) One (1) member appointed by the governor based on therecommendation of the National Medical Association.
        (14) One (1) member appointed by the governor based on therecommendation of the Indiana Hospital and HealthAssociation.
        (15) One (1) member appointed by the governor based on therecommendation of the American Cancer Society.
        (16) One (1) member appointed by the governor based on therecommendation of the American Heart Association.
        (17) One (1) member appointed by the governor based on therecommendation of the American Diabetes Association.
        (18) One (1) member appointed by the governor based on therecommendation of the Black Nurses Association.
        (19) One (1) member appointed by the governor based on therecommendation of the Indiana Minority Health Coalition.
    (b) At least fifty-one percent (51%) of the members of the councilmust be minorities.

Appointments
    
Sec. 5. All appointments to the council are for two (2) years. Amember may be reappointed to the commission for succeeding terms.

Chairman
    
Sec. 6. The council shall select a chairman from the membershipannually.

Vacancy appointments
    
Sec. 7. Appointments to fill a vacancy are for the remainder of anunexpired term and are made by the authority who made the originalappointment.

IC 16-46-6-8 Staff
    
Sec. 8. The state department and the Indiana Minority HealthCoalition, Inc. shall provide staff for the council.

Meetings
    
Sec. 9. The council shall hold at least four (4) meetings annually.

IC 16-46-6-10
Duties
    
Sec. 10. The council shall do the following:
        (1) Identify and study the special health care needs and healthproblems of minorities.
        (2) Examine the factors and conditions that affect the health ofminorities.
        (3) Examine the health care services available to minorities inthe public and private sector and determine the extent to whichthese services meet the needs of minorities.
        (4) Study the state and federal laws concerning the health needsof minorities.
        (5) Examine the coordination of services to minorities andrecommend improvements in the delivery of services.
        (6) Examine funding sources for minority health care.
        (7) Examine and recommend preventive measures concerningthe leading causes of death or injury among minorities,including the following:
            (A) Heart disease.
            (B) Stroke.
            (C) Cancer.
            (D) Intentional injuries.
            (E) Accidental death and injury.
            (F) Cirrhosis.
            (G) Diabetes.
            (H) Infant mortality.
            (I) HIV and acquired immune deficiency syndrome.
            (J) Mental Health.
            (K) Substance Abuse.
        (8) Examine the impact of the following on minorities:
            (A) Adolescent pregnancy.
            (B) Sexually transmitted and other communicable diseases.
            (C) Lead poisoning.
            (D) Long term disability and aging.
            (E) Sickle cell anemia.
        (9) Monitor the Indiana minority health initiative and otherpublic policies that affect the health status of minorities.
        (10) Develop and implement a comprehensive plan and timeline to address health disparities and health issues of minoritypopulations in Indiana.As added by P.L.2-1993, SEC.29. Amended by P.L.194-1995, SEC.3;P.L.242-2003, SEC.4.

Annual reports
    
Sec. 11. The council shall submit a report in an electronic formatunder IC 5-14-6 to the general assembly before November 1 of eachyear. The report must include the following:
        (1) The findings and conclusions of the council.
        (2) Recommendations of the council.

Violations
    
Sec. 12. (a) Except as otherwise provided, a person whorecklessly violates or fails to comply with this chapter commits aClass B misdemeanor.
    (b) Each day a violation continues constitutes a separate offense.

IC 16-46-6-13
Per diem compensation and traveling expenses
    
Sec. 13. (a) Each member of the council who is not a stateemployee is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). The council member is also entitled toreimbursement for traveling expenses as provided under IC 4-13-1-4and other expenses actually incurred in connection with the member'sduties as provided in the state policies and procedures established bythe Indiana department of administration and approved by the budgetagency.
    (b) Each member of the council who is a state employee is entitledto reimbursement for traveling expenses as provided underIC 4-13-1-4 and other expenses actually incurred in connection withthe member's duties as provided in the state policies and proceduresestablished by the Indiana department of administration andapproved by the budget agency.
    (c) Expenses incurred under this section must be paid out of thefunds appropriated to the state department.
