Chapter 2. Commission on Interstate Cooperation

Creation; membership; powers and duties
Sec. 1. (a) A state commission to be known as the commission oninterstate cooperation is created.
(b) In addition to the other purposes specified in this chapter, it isthe function of the commission to carry forward the participation ofthis state as a member of the Council of State Governments, whichcouncil is declared to be a joint governmental agency of this stateand of the other states which cooperate through it.
(c) There is established a senate standing committee on interstatecooperation, the members and the chairman thereof to be designatedat each session of the general assembly by the president pro temporeof the senate. In addition to the regular members, the president protempore of the senate and the senate minority leader are ex officio,nonvoting members of this committee.
(d) There is established a house of representatives standingcommittee on interstate cooperation, the members and the chairmanthereof to be designated at each session of the general assembly bythe speaker of the house of representatives. In addition to the regularmembers, the speaker of the house of representatives and the houseminority leader are ex officio, nonvoting members of this committee.
(e) The commission on interstate cooperation consists of themembers of the senate committee on interstate cooperation and themembers of the house of representatives committee on interstatecooperation. Five (5) additional persons, who shall be administrativeoffice holders or employees of the state of Indiana, may be appointedby the governor to act in an advisory capacity to the commission. Inaddition to the regular members, the governor is ex officio anhonorary nonvoting member of the commission.
(f) The senate committee on interstate cooperation and the houseof representatives committee on interstate cooperation shall functionduring the regular sessions of the general assembly and also duringthe interim periods between such sessions. Their members shall serveuntil their successors are designated. The incumbency of eachadministrative member of this commission shall extend untilFebruary 1 next following his appointment and thereafter until hissuccessor is appointed.
(g) It is the further function of the commission to endeavor toadvance cooperation between this state and other units ofgovernment whenever it seems advisable to do so by formulatingproposals for and by facilitating:
(1) the adoption of compacts;
(2) the enactment of uniform or reciprocal statutes;
(3) the adoption of uniform or reciprocal administrative rulesand regulations;
(4) the informal cooperation of governmental offices with oneanother; (5) the personal cooperation of governmental officials andemployees;
(6) the interchange and clearance of research and information;and
(7) any other suitable purpose.
(h) The commission may, by contributions to the Council of StateGovernments, participate with other states in maintaining thecouncil's secretariats and its other governmental services.

Flood control; other duties; hearings
Sec. 2. (a) The commission shall act as the agency of this state inassisting in the institution and consummation of federal and statematters requiring cooperation between this state and other states andthe federal government, including flood control and regulation offlood waters in the areas of this state where hazards from floodwaters obtain, and in cooperating with any department or agency ofthe federal government duly authorized to institute and consummatesuch a program and to expend moneys made available therefor andin cooperating with any organization created in this state for thepurpose of controlling flood waters and to meet and to act with andin cooperation with any like commission or commissions or agenciesof any other state.
(b) The commission may sit in any place within or without thestate and hold either public or private hearings.
(c) Without regard to the time of the sitting of the generalassembly, the commission shall generally have, possess, and exerciseall of the powers possessed by a committee of the general assemblywhile acting during a session of the general assembly.

Legislative members of commission; per diem, mileage, and travelallowances
Sec. 3. The legislative members of the commission are entitled toreceive the same per diem, mileage, and travel allowances paid topersons who serve as legislative members of interim studycommittees established by the legislative council. These allowancesshall be paid by the legislative services agency from the amountsappropriated for that purpose.

Resolutions related to commission's function; study and report onmatters referred to commission; subcommittees; request forassistance or information; staff and support
Sec. 4. (a) The legislative council may refer by resolution any
matter related to the commission's function as described in section1(g) of this chapter.
(b) When any matter is referred to the commission by thelegislative council, the commission shall conduct a study of thematter and shall make a report of the study results in an electronicformat under IC 5-14-6 to the legislative council.
(c) The commission may appoint subcommittees, subject to theauthority of the commission, to carry out studies on matters relatedto its functions.
(d) The commission may request and shall receive from anydepartment, division, board, commission, or agency of this state orof any political subdivision thereof or from any organization,incorporated or unincorporated, such assistance, information, anddata as will enable it properly to carry out its activities and effectuateits purposes under this chapter.
(e) The legislative services agency shall provide staff support tothe commission.
