    Chapter 29. Youth Advisory Council

"Council"
    
Sec. 1. As used in this chapter, "council" refers to the youthadvisory council established by section 2 of this chapter.

Youth advisory council established
    
Sec. 2. The youth advisory council is established to provide to thegeneral assembly information from young people concerning issuesthat are of importance to youth in Indiana, including:
        (1) education;
        (2) employment;
        (3) strategies to increase youth involvement in state and localgovernment;
        (4) safe environments for youth;
        (5) substance abuse;
        (6) emotional and physical health;
        (7) foster care;
        (8) poverty;
        (9) homelessness; and
        (10) youth access to state and local services.

Appointment of members; terms
    
Sec. 3. (a) The council consists of the following twenty-two (22)members, who must be at least sixteen (16) years of age and notmore than twenty (20) years of age at the time of appointment:
        (1) Five (5) members appointed by the president pro tempore ofthe senate.
        (2) Five (5) members appointed by the minority leader of thesenate.
        (3) Five (5) members appointed by the speaker of the house ofrepresentatives.        (4) Five (5) members appointed by the minority leader of thehouse of representatives.
        (5) Two (2) members appointed by the governor.
    (b) The members of the council shall be selected so as to giverepresentation to the various geographical areas of Indiana.
    (c) The members of the council shall annually elect a chairpersonof the council from among the members.
    (d) Members of the council shall serve for a two (2) year term andmay be reappointed.
    (e) The appointing authority may remove an appointed member ofthe council for cause. Cause includes the failure to attend at least two(2) meetings within a one (1) year period.

Attendance at meeting; excused absence from school
    
Sec. 3.6. (a) This section applies to a student who attends eithera public school or a nonpublic school.
    (b) Attending a meeting of the council as a member is a lawfulexcuse for a student to be absent from school, when verified by acertificate of the state superintendent of public instruction. A studentexcused from school attendance under this section may not berecorded as being absent on any date for which the excuse isoperative and may not be penalized by the school in any manner.

Council duties
    
Sec. 4. The council has the following duties:
        (1) To advise the general assembly concerning proposed andpending legislation, including budget expenditures and policymatters related to youth.
        (2) To advise the standing committees and study committees ofthe general assembly concerning issues related to youth.
        (3) To conduct periodic seminars for members of the councilconcerning leadership, government, and the general assembly.
        (4) To report to the general assembly, not later than December1 of each year, concerning the council's activities, including anyproposed legislation to implement recommendations of thecouncil. The report must be in an electronic format underIC 5-14-6.

Meetings; voting
    
Sec. 5. (a) The council shall meet at least three (3) times, and notmore than six (6) times, per year.
    (b) Meetings held under this section must include not more thantwo (2) public hearings per year concerning issues of importance toyouth.    (c) The affirmative votes of a majority of the members appointedto the council are required for the council to take action on anymeasure, including annual reports.

Supervision and staff
    
Sec. 6. (a) The Indiana bar foundation's center for civic educationshall supervise the activities of the council.
    (b) The Indiana bar foundation's center for civic education shallstaff the council.

Expenses; per diem
    
Sec. 7. (a) The expenses of the council shall be paid from thebudget of the department of education.
    (b) Each member of the council is entitled to the minimum salaryper diem provided by IC 4-10-11-2.1(b). The member is also entitledto reimbursement for traveling expenses as provided underIC 4-13-1-4 and other expenses actually incurred in connection withthe member's duties as provided in the state policies and proceduresestablished by the Indiana department of administration andapproved by the budget agency.

Youth advisory council fund
    
Sec. 7.5. (a) The youth advisory council fund is established as adedicated fund to be administered by the office. The fund consists of:
        (1) appropriations made to the fund by the general assembly;and
        (2) grants, gifts, and donations intended for deposit in the fund.
    (b) Expenses of administering the fund shall be paid from moneyin the fund.
    (c) The treasurer of state shall invest the money in the fund notcurrently needed to meet the obligations of the fund in the samemanner as other public money may be invested. Interest that accruesfrom these investments shall be deposited in the fund.
    (d) Money in the fund at the end of a fiscal year does not revert tothe state general fund.
    (e) Money in the fund is available, with the approval of the budgetagency, to augment and supplement the funds appropriated to thedepartment of education to implement this chapter.
