    Chapter 4. Duties of the Commission

Forms for documents
    
Sec. 1. The commission shall prescribe forms for the registrationstatements, activity reports, and other documents required to be filedunder this article and make the forms available to persons requiredto file the registration statements, activity reports, and otherdocuments.

Sec. 2. The commission shall prepare and publish a manual settingforth recommended, uniform methods of reporting for use by personsrequired to file statements and reports under this article.

Documents; availability for public inspection
    
Sec. 3. The commission shall make statements, reports, and otherdocuments filed with the commission under this article available forpublic inspection and copying during regular office hours and makecopying facilities available to the public at a charge not to exceedactual cost.

Sec. 4. The commission shall compile and maintain an index of allreports and statements filed with the commission under this articleto facilitate public access to these reports and statements.

Sec. 5. The commission shall prepare and publish annualsummaries of statements and reports filed with the commission underthis article.

Sec. 5.5. (a) The commission shall make copies of all thefollowing available on the Internet:
        (1) Reports, statements, other documents required to be filedunder this article.
        (2) Manuals, indices, summaries, and other documents thecommission is required to compile, publish, or maintain underthis article.
    (b) The commission shall make copies of all reports required tobe made by legislative liaisons under IC 5-14-7 available on theInternet.

    Sec. 6. (a) The commission shall inspect and audit at least fivepercent (5%) of all registration statements and reports filed with thecommission under this chapter by requiring the registrant to produceverifying documents. The statements and reports inspected andaudited shall be selected at random by a computer random numbergenerator. Nothing in this chapter shall be construed as prohibitingthe commission from inspecting and auditing any statement or reportif the commission has reason to believe that a violation of thischapter may have occurred.
    (b) Verifying documents under this section while in thepossession of the commission are confidential.

    Sec. 6. Violations; notification to persons required to file statements andreports; failure to file; reporting for prosecution
    
Sec. 7. The commission shall notify by certified mail, returnreceipt requested, persons required to file statements and reportsunder this article of any violations or errors discovered duringinspections or audits conducted under section 6 of this chapter withinthirty (30) days of the discovery of the errors or violations. Theperson required to file statements and reports under this article shallwithin thirty (30) days from receipt of notification file a correctedstatement or report meeting all requirements set forth in this article.If no corrected statement or report is filed within thirty (30) days, orif violations remain following the filing of a corrected report orstatement, then the commission shall forward to the prosecutingattorney of the applicable judicial circuit and to the attorney generalreports of any violations. However, if the prosecutor has not initiatedprosecution within sixty (60) days of receipt of such notice or withinsixty (60) days of the written request for prosecution by the attorneygeneral, the attorney general may prosecute on behalf of the state.

Statements and reports; preservation
    
Sec. 8. The commission shall preserve statements and reports filedwith the commission under this article for a period of four (4) yearsfrom the date of receipt.

Powers
    
Sec. 9. The commission has all powers necessary to accomplishthe responsibilities assigned to the commission in this chapter.
