Chapter 4. Education Roundtable

"Roundtable"
Sec. 1. As used in this chapter, "roundtable" refers to theeducation roundtable established by section 2 of this chapter.

Sec. 2. The education roundtable is established.

Membership
Sec. 3. The roundtable consists of the following members:
(1) A number of members appointed jointly by the governor andthe state superintendent. These members must berepresentatives of:
(A) business and community leaders;
(B) elementary and secondary education, including programsfor exceptional learners (as defined in IC 20-31-2-6); and
(C) higher education.
The number of members appointed under clause (A) must beequal to the number of members appointed under clauses (B)and (C).
(2) Two (2) members appointed by the president pro tempore ofthe senate from different political parties.
(3) Two (2) members appointed by the speaker of the house ofrepresentatives from different political parties.

Compensation and expenses of members
Sec. 4. (a) A member of the roundtable is not entitled to a salaryper diem.
(b) A member of the roundtable is entitled to reimbursement fortraveling expenses and other expenses actually incurred inconnection with the member's duties, as provided in the state travelpolicies and procedures established by the Indiana department ofadministration and approved by the budget agency.

Cochairpersons; quorum
Sec. 5. (a) The governor and the state superintendent shall jointlyserve as cochairpersons of the roundtable. The roundtable shall meetupon the call of the cochairpersons.
(b) A quorum of the roundtable must be present to conduct
business. A quorum consists of a majority of the voting membersappointed to the roundtable. The roundtable may not take an officialaction unless the official action has been approved by at least amajority of the voting members appointed to serve on the roundtable.

Permanence of roundtable
Sec. 6. The roundtable is a permanent body and working group.

Recommendations concerning matters related to education
Sec. 7. (a) The roundtable shall provide recommendations onsubjects related to education to the following:
(1) The governor.
(2) The state superintendent.
(3) The general assembly.
(4) The state board.
(b) The recommendations to the general assembly must be in anelectronic format under IC 5-14-6.

Recommendations; determination of total estimated fiscal impactby roundtable and legislative services agency
Sec. 8. (a) As used in this section, "total estimated fiscal impact"means the annual fiscal impact of a recommendation on all affectedentities after the recommendation is fully implemented undersubsection (e).
(b) Subject to subsection (d), before providing a recommendationunder section 7 of this chapter, the roundtable shall prepare ananalysis of the total estimated fiscal impact that the recommendationwill have on the state, political subdivisions, and all private schoolsaffected by the recommendation. In preparing an analysis under thissubsection, the roundtable shall consider any applicable informationsubmitted by entities affected by the recommendation. The analysisprepared under this subsection must be submitted with therecommendation under section 7 of this chapter.
(c) If the roundtable provides a recommendation under section 7of this chapter and the total estimated fiscal impact analysis preparedunder subsection (b) indicates that the impact of the recommendationwill be at least five hundred thousand dollars ($500,000), theroundtable shall submit a copy of the recommendation and the fiscalanalysis prepared under subsection (b) to the legislative servicesagency for review. This recommendation must be in an electronicformat under IC 5-14-6. Not more than forty-five (45) days afterreceiving a copy of the recommendation and fiscal impact analysis,the legislative services agency shall prepare a fiscal impact statementconcerning the effect that compliance with the recommendation will
have on:
(1) the state; and
(2) all:
(A) political subdivisions; and
(B) nonpublic schools;
affected by the proposed recommendation.
The fiscal impact statement must contain the direct total estimatedfiscal impact of the recommendation and a determination concerningthe extent to which the recommendation creates an unfundedmandate on the state, a political subdivision, or a nonpublic schoolaffected by the proposed recommendation. The fiscal impactstatement is a public document. The legislative services agency shallmake the fiscal impact statement available to interested parties uponrequest. The roundtable shall provide the legislative services agencywith the information necessary to prepare the fiscal impact statement.The legislative services agency may also receive and considerapplicable information from the entities affected by therecommendation in preparation of the fiscal impact statement. Thelegislative services agency shall provide copies of its fiscal impactstatement to each of the persons described in section 7 of thischapter.
(d) In determining whether a recommendation under this sectionhas a total estimated fiscal impact of at least five hundred thousanddollars ($500,000) on the affected entities, the roundtable shallconsider the impact of the recommendation on any entity that alreadycomplies with the standards imposed by the recommendation on avoluntary basis, if applicable.
(e) For purposes of this section, a recommendation is fullyimplemented after:
(1) the conclusion of any phase-in period during which:
(A) the recommendation is gradually made to apply tocertain affected entities; or
(B) the costs of the recommendation are graduallyimplemented; and
(2) the recommendation applies to all affected entities that willbe affected by the recommendation.
In determining the total estimated fiscal impact of a recommendationunder this section, the roundtable shall consider the annual fiscalimpact on all affected entities beginning with the first twelve (12)month period or first school year after the recommendation is fullyimplemented, whichever applies. The roundtable may use actual orforecasted data and may consider the actual and anticipated effectsof inflation and deflation. The roundtable shall describe anyassumptions made and any data used in determining the totalestimated fiscal impact of a recommendation under this section.

Recommendations for improving academic standards Sec. 9. The roundtable shall make recommendations to the stateboard for improving the academic standards under IC 20-31-3.

Review and recommendation of academic standards and ISTEPprogram
Sec. 10. The roundtable shall review and recommend to the stateboard for the state board's approval the following:
(1) The academic standards under IC 20-31-3, IC 20-32-4,IC 20-32-5, and IC 20-32-6 for all grade levels fromkindergarten through grade 12.
(2) The content and format of the ISTEP program, including thefollowing:
(A) The graduation examination.
(B) The passing scores required at the various grade levelstested under the ISTEP program.

Considerations in making recommendations
Sec. 11. In making recommendations under section 10 of thischapter, the roundtable shall consider:
(1) a variety of available national and international assessmentsand tests;
(2) the development of an assessment or test unique to Indiana;and
(3) any combination of assessments or tests described undersubdivisions (1) and (2).

Recommendations to state board
Sec. 12. In making recommendations under section 10 of thischapter, the roundtable shall recommend to the state board only statetests that when appropriate:
(1) present the content of each test in an interdisciplinarymanner; and
(2) provide each student with the opportunity to meet theacademic standards in an applied manner.

Sec. 13. The state board may adopt rules under IC 4-22-2 toimplement this chapter.
