    Chapter 14. Educational Technology Council

Sec. 1. As used in this chapter, "council" refers to the educationaltechnology council established by section 2 of this chapter.

Advisory duties; members; quorum; per diem and expenses
    
Sec. 3. (a) The council shall advise the state superintendent andthe governor on education related technology initiatives.
    (b) The appointed membership of the council shall reflect itspurposes and be experienced in technology generally. An appointedmember of the council serves at the pleasure of the appointingauthority. The council consists of the following sixteen (16) votingmembers:
        (1) The state superintendent.
        (2) The special assistant to the state superintendent of publicinstruction responsible for technology who is appointed undersection 5 of this chapter.
        (3) Four (4) individuals who represent private businessappointed jointly by the state superintendent and the governor.Each member appointed under this subdivision must beexperienced in development and use of information technology.A member appointed under this subdivision may not representpossible providers of technology or related services.
        (4) Three (3) individuals who:
            (A) manage educational environments, includingpostsecondary education; and
            (B) are experienced in their educational work withinformation technology;
        are appointed jointly by the state superintendent and thegovernor.
        (5) Three (3) individuals who are public school educatorsfamiliar with and experienced in the use of technology ineducational settings appointed jointly by the statesuperintendent and the governor, with one (1) representing anurban school corporation, one (1) representing a suburbanschool corporation, and one (1) representing a rural schoolcorporation.
        (6) Four (4) members who are members of the general assemblyand who are appointed as follows:
            (A) Two (2) members of the house of representatives,

appointed by the speaker of the house of representatives withnot more than one (1) from a particular political party.
            (B) Two (2) members of the senate, appointed by thepresident pro tempore of the senate with not more than one(1) from a particular political party.
    (c) The state superintendent shall designate the chair of thecouncil from the membership of the council.
    (d) Nine (9) members of the council constitute a quorum toconduct business. Action of the council is not valid unless approvedby at least nine (9) voting members of the council.
    (e) Each member of the council who is not a state employee is notentitled to the minimum salary per diem as provided byIC 4-10-11-2.1(b). The member is, however, entitled toreimbursement for traveling expenses as provided under IC 4-13-1-4and other expenses actually incurred in connection with the member'sduties as provided in the state policies and procedures established bythe Indiana department of administration and approved by the budgetagency.
    (f) Each member of the council who is a state employee but whois not a member of the general assembly is entitled to reimbursementfor traveling expenses as provided under IC 4-13-1-4 and otherexpenses actually incurred in connection with the member's duties asprovided in the state policies and procedures established by theIndiana department of administration and approved by the budgetagency.
    (g) Each member of the council who is a member of the generalassembly is entitled to receive the same per diem, mileage, and travelallowances paid to members of the general assembly serving oninterim study committees established by the legislative council.

Employment of personnel and consultants
    
Sec. 4. The department may employ personnel or consultants, orboth, to carry out the council's duties and functions.

Appointment of special assistant for technology
    
Sec. 5. (a) The state superintendent shall appoint a specialassistant for technology. The person appointed under this sectionserves at the pleasure of the state superintendent.
    (b) The person appointed under subsection (a) must beexperienced in the integration of educational technology initiatives,infrastructure management and support, and applied research intoeffective educational practices available to students and educators inthe classroom. The state superintendent is encouraged to conduct anationwide search for the best available talent to fill the positionrequired by this section.    (c) The person appointed under subsection (a) shall coordinate theduties and functions of the department and the council under thefollowing:
        (1) IC 20-20-13 (educational technology program and grants).
        (2) This chapter.
        (3) Any other law concerning educational technology ortelecommunications.
