    Chapter 30. Anti-Gang Counseling Pilot Program and Fund

"Anti-gang counseling"
    
Sec. 1. As used in this chapter, "anti-gang counseling" refers toefforts described under section 8 of this chapter that are designed todiscourage students from the following:
        (1) Becoming members of criminal gangs.
        (2) Engaging in criminal gang activity.

"Criminal gang"
    
Sec. 2. As used in this chapter, "criminal gang" has the meaningas set forth in IC 35-45-9-1.

"Fund"
    
Sec. 3. As used in this chapter, "fund" refers to the anti-gangcounseling pilot program fund established by section 9 of thischapter.

"Participating school corporation"
    
Sec. 4. As used in this chapter, "participating school corporation"refers to a school corporation or more than one (1) schoolcorporation under a joint agreement selected by the department toparticipate in the pilot program.

"Pilot program"
    
Sec. 5. As used in this chapter, "pilot program" refers to theanti-gang counseling pilot program established by section 8 of thischapter.

"Pilot project"
    
Sec. 6. As used in this chapter, "pilot project" refers to ananti-gang counseling pilot project authorized under section 8 of thischapter.

"Student"
    
Sec. 7. As used in this chapter, "student" refers to a public school

student who is in an appropriate grade level as determined by theparticipating school corporation.

Establishment of pilot projects; purposes
    
Sec. 8. The department shall establish the anti-gang counselingpilot program to provide financial assistance to participating schoolcorporations to establish pilot projects designed to do the following:
        (1) Educate students and parents:
            (A) of the extent to which criminal gang activity exists in theschool corporation's community;
            (B) on the negative societal impact that criminal gangs haveon the community; and
            (C) on methods to discourage participation in criminalgangs.
        (2) Encourage the use of community resources not directlyaffiliated with the school corporation, including lawenforcement officials, to participate in the particular pilotproject.
        (3) Enable the participating school corporations on a case bycase basis and with the prior written approval of the student'sparent to contract with community mental health centers toprovide appropriate anti-gang counseling to a student identifiedby the student's school guidance counselor as being at risk ofbecoming a member of a criminal gang or at risk of engaging incriminal gang activity.

Establishment and administration of fund
    
Sec. 9. (a) The anti-gang counseling pilot program fund isestablished to provide grants to participating school corporations toestablish and operate the school corporation's pilot project.
    (b) The department shall administer the fund.
    (c) The expenses of administering the fund shall be paid frommoney in the fund.
    (d) The treasurer of state shall invest the money in the fund notcurrently needed to meet the obligations of the fund in the samemanner as other public funds may be invested.

Application for grant
    
Sec. 10. (a) To be eligible for a grant under this chapter, a schoolcorporation or more than one (1) school corporation under a jointagreement must timely apply for the grant to the department on formsprovided by the department.
    (b) The applying school corporation must include at least thefollowing information in the school corporation's application:        (1) The number of students likely to benefit from the pilotproject.
        (2) A detailed description of the proposed pilot project format.
        (3) The extent to which the applying school corporation intendsto include appropriate community resources not directlyaffiliated with the applying school corporation in the pilotproject.
        (4) A statement of and any supporting information concerningthe need to establish the pilot project as perceived by theapplying school corporation.
        (5) The estimated cost of implementing the pilot project.
        (6) Any other pertinent information required by the department.

Approval of pilot projects; criteria
    
Sec. 11. (a) The department may approve not more than three (3)pilot projects from each congressional district.
    (b) The department shall approve the pilot projects based on atleast the following criteria:
        (1) The relative need for the establishment of a pilot project ofthis nature as outlined by the applying school corporation,including the number of students who would likely benefit fromthe pilot project and the prevalence of criminal gang activitywithin the boundaries of the applying school corporation.
        (2) The overall quality of the applying school corporation's pilotproject proposal, including the extent to which the applyingschool corporation demonstrates a willingness to include as apart of the pilot project appropriate community resources notdirectly affiliated with the applying school corporation.
        (3) The availability of money in the fund.

Reports
    
Sec. 12. (a) By June 1 of each school year, each participatingschool corporation shall submit to the department a written report, onforms developed by the department, outlining the activitiesundertaken as part of the school corporation's pilot project.
    (b) By November 1 of each year, the department shall submit acomprehensive report to the governor and the general assembly onthe pilot program, including the department's conclusions andrecommendations with regard to the impact that the pilot programhas made on decreasing criminal gang activity in Indiana. A reportsubmitted under this subsection to the general assembly must be inan electronic format under IC 5-14-6.
