Nonconversion charter schools open to all Indiana students
    
Sec. 1. Except as provided in this chapter, a charter school that isnot a conversion charter school must be open to any student whoresides in Indiana.

Attendance at charter school outside district of residence
    
Sec. 2. (a) A student may attend a charter school outside thedistrict in which the student resides if the student's parent determinesthat an academic program at the charter school would enhance thestudent's academic opportunities.
    (b) If the governing body of the school corporation in which thestudent resides determines that a transfer would not improve thestudent's academic opportunities, the governing body may appeal tothe state board. Not later than forty-five (45) days after receiving theappeal, the state board shall conduct a hearing and decide whether touphold or reverse the parent's decision to enroll the student in thecharter school.
    (c) During the state board's consideration, the parents of thestudent may testify, but the governing body has the burden of prooffor demonstrating that the charter school does not provide additionalor unique academic opportunities that exceed those available at theschool corporation.

Conversion charter schools; students residing in and outside localschool corporation
    
Sec. 3. Except as provided in this chapter, a conversion charterschool must be open to any student residing in the local schoolcorporation. By joint agreement of the sponsor and organizer, aconversion charter school may enroll students residing outside thelocal school corporation.

Admission policies
    
Sec. 4. Except as provided in this chapter, a charter school maynot establish admission policies or limit student admissions in anymanner in which a public school is not permitted to establishadmission policies or limit student admissions.

Limits on attendance    Sec. 5. (a) Except as provided in subsections (b), (c), and (d), acharter school must enroll any eligible student who submits a timelyapplication for enrollment.
    (b) This subsection applies if the number of applications for aprogram, class, grade level, or building exceeds the capacity of theprogram, class, grade level, or building. If a charter school receivesa greater number of applications than there are spaces for students,each timely applicant must be given an equal chance of admission.
    (c) A charter school may limit new admissions to the charterschool to:
        (1) ensure that a student who attends the charter school duringa school year may continue to attend the charter school insubsequent years; and
        (2) allow the siblings of a student who attends a charter schoolto attend the charter school.
    (d) This subsection applies to an existing school that converts toa charter school under IC 20-24-11. During the school year in whichthe existing school converts to a charter school, the charter schoolmay limit admission to:
        (1) those students who were enrolled in the charter school onthe date of the conversion; and
        (2) siblings of students described in subdivision (1).
