Chapter 13. Motorcycle Operator Safety Education

"Certified chief instructor"
Sec. 1. As used in this chapter, "certified chief instructor" meansa licensed motorcycle operator who meets standards established bythe department that are equivalent to or more stringent than thoseestablished by the Motorcycle Safety Foundation for instructors inmotorcycle safety and education.

"Fund"
Sec. 2. As used in this chapter, "fund" refers to the motorcycleoperator safety education fund established by section 11 of thischapter.

"Program"
Sec. 3. As used in this chapter, "program" means the motorcycleoperator safety education program.

"Program coordinator"
Sec. 4. As used in this section, "program coordinator" refers to thecoordinator of the motorcycle operator safety education program.

"Training course"
Sec. 5. As used in this chapter, "training course" means anapproved motorcycle operator education course that meets standardsestablished by the department that are equivalent to or more stringentthan those established by the Motorcycle Safety Foundation forcourses of instruction in motorcycle safety and education.

"Training specialist"
Sec. 6. As used in this chapter, "training specialist" means thetraining specialist of the motorcycle operator safety educationprogram.

Motorcycle operator safety education program
Sec. 7. The department shall develop and administer a motorcycle
operator safety education program that, at a minimum, must:
(1) provide motorcycle operator education;
(2) provide instructor training;
(3) increase public awareness of motorcycle safety; and
(4) evaluate and recommend improvements to the motorcycleoperator licensing system.

Appointment of program coordinator and training specialist
Sec. 8. The state superintendent shall appoint:
(1) a program coordinator who shall administer the program andconduct an annual evaluation; and
(2) a training specialist who shall:
(A) establish training courses throughout Indiana;
(B) set program and funding guidelines; and
(C) supervise instructors and other personnel as necessary.
The training specialist must be a certified chief instructor and holda valid license to operate a motorcycle.

Contracts with regional training centers
Sec. 9. The department may enter into contracts with regionaltraining centers or any other sites approved by the statesuperintendent for the conduct of motorcycle operator safetyeducation courses. If necessary, course sites may charge a reasonabletuition fee for the courses.

Advisory committee
Sec. 10. The state superintendent shall appoint a five (5) memberadvisory committee consisting of at least three (3) activemotorcyclists to serve in an advisory capacity to the program.

Establishment of fund
Sec. 11. The motorcycle operator safety education fund isestablished. The fund consists of money received from motorcycleregistrations as provided under IC 9-29. The money in the fund isappropriated to the department for the administration of the programand expenses related to the program, including:
(1) reimbursement for course sites;
(2) instructor training;
(3) purchase of equipment and course materials; and
(4) technical assistance.
