    Chapter 1. Definitions

IC 20-35-1-1
Application
    Sec. 1. The definitions in this chapter apply throughout thischapter, IC 20-35-2 through IC 20-35-6, and IC 20-35-8.

IC 20-35-1-2
"Child with a disability"
    Sec. 2. "Child with a disability" means a child who:
        (1) is at least three (3) years of age but less than twenty-two(22) years of age; and
        (2) because of physical or mental disability is incapable ofbeing educated properly and efficiently through normalclassroom instruction, but who, with the advantage of a specialeducational program, may be expected to benefit frominstruction in surroundings designed to further the educational,social, or economic status of the child.

"Director"
    Sec. 3. "Director" refers to the director of the division of specialeducation.

"Division"
    Sec. 4. "Division" refers to the division of special educationestablished by IC 20-35-2-1.

"Preschool child with a disability"
    Sec. 5. "Preschool child with a disability" refers to a child with adisability who is at least three (3) years of age by June 1 of theschool year.

"School corporation"
    Sec. 6. "School corporation" means a corporation authorized bylaw to establish public schools and levy taxes for the maintenance ofthe schools.As added by P.L.1-2005, SEC.19.

IC 20-35-1-7
"Special education"
    Sec. 7. "Special education" means instruction specially designedto meet the unique needs of a child with a disability. The termincludes transportation, developmental, corrective, and other supportservices and training only when required to assist a child with adisability to benefit from the instruction itself.
