    Chapter 10. Inclusion School Pilot Program

"Child with disabilities"
    
Sec. 1. As used in this chapter, "child with disabilities" means achild (as defined in IC 20-35-1-2) whose individualized educationprogram recommends that the child participate in an inclusion schoolprogram.

"Inclusion school"
    
Sec. 2. As used in this chapter, "inclusion school" means a publicschool that:
        (1) participates in the pilot program under this chapter as aninclusion school;
        (2) as an inclusion school, educates each child with disabilitiesin the school located in the child's attendance area in the schoolcorporation of the child's legal settlement; and
        (3) integrates each child with a disability in regular educationclasses for as much of the student instructional day as possibleto normalize the child's academic learning and socialexperience.

"Regular education"
    
Sec. 3. As used in this chapter, "regular education" meansclassroom instruction:
        (1) in which children without disabilities are routinely placed;and
        (2) that is not characterized as special education under thisarticle.

Program established; purposes
    
Sec. 4. The inclusion school pilot program is established toprovide financial assistance through competitive grants awarded bythe department under section 5 of this chapter to school corporationsto do the following:
        (1) Develop supportive regular education school and classroomcommunities that nurture, support, and enhance the educationaland social needs of each child enrolled in the inclusion school.
        (2) Integrate children with disabilities into the inclusion schoolslocated in the child's attendance area in the school corporationof the child's legal settlement.
        (3) Provide children with disabilities the opportunity to becomean integral part of the total school experience while focusing on

meeting the needs of all classes of children and without areduction in the quality of the content of the educationalprogram being provided to children with disabilities.
        (4) Foster cooperation and integration among regular educationteachers and special education teachers.

Program funding
    
Sec. 5. (a) The money annually available to the department toaward the grants under this chapter is derived from the unexpendedmoney at the end of a state fiscal year that was originallyappropriated to the department for the program for preschoolchildren with disabilities under IC 20-35-4-9, not to exceed twohundred thousand dollars ($200,000).
    (b) On July 1 of each year, the budget agency shall make availableto the department the appropriate amount of money for use under thischapter as designated under subsection (a).

Award of grants
    
Sec. 6. (a) The department may award competitive grants to notmore than ten (10) school corporations each year to conductinclusion school programs.
    (b) The grants under this chapter must be used by a recipientschool corporation to provide planning, collaboration, and stafftraining and development necessary for the implementation of theschool corporation's inclusion school pilot program.

Grant applications
    
Sec. 7. (a) To be eligible to receive a grant under this chapter, aschool corporation must apply to the department, on forms preparedby the department, for the grant.
    (b) The school corporation must include the following in theschool corporation's application:
        (1) A detailed description of the nature of the schoolcorporation's inclusion school pilot program.
        (2) Any other information required by the department.

Grant criteria
    
Sec. 8. The department shall award grants to a recipient schoolcorporation based on the following criteria:
        (1) The school corporation's experience in delivering innovativeinstruction to children with disabilities.
        (2) The completion of the appropriate application.        (3) The degree to which the:
            (A) school corporation;
            (B) each school in which the inclusion school pilot programwill be implemented;
            (C) school staff (including the support of the exclusiverepresentative); and
            (D) school community;
        exhibit commitment to the inclusion school pilot program.
        (4) Any other criteria established by the department.

Reports
    
Sec. 9. Each recipient school corporation must submit to thedepartment:
        (1) an annual report; and
        (2) any interim reports that the department requires;
concerning the school corporation's inclusion school pilot program.

Guidelines
    
Sec. 10. The department shall develop guidelines to implementthis chapter.
