    Chapter 5. Racial Balance Fund

Application
    Sec. 1. This chapter applies only to a school corporation that mayimpose a levy under IC 20-46-3.

"Fund"
    Sec. 2. As used in this chapter, "fund" refers to a racial balancefund established under section 4 of this chapter.

"Levy"
    Sec. 3. As used in this chapter, "levy" refers to a property tax levyimposed under IC 20-46-3 for the fund.

Establishment of fund
    Sec. 4. A school corporation may establish a racial balance fund.

IC 20-40-5-5
Uses
    Sec. 5. Money in the fund may be used only for educationprograms that improve or maintain racial balance in the schoolcorporation. Money in the fund may not be used for:
        (1) transportation; or
        (2) capital improvements;
even though those costs may be attributable to the schoolcorporation's proposed programs for improving or maintaining racialbalance in the school corporation.
