    Chapter 2. Maximum State Distribution

Distribution schedule; reversions
    
Sec. 1. The department shall distribute the amount appropriatedby the general assembly for distribution as state tuition support inaccordance with this article. If the appropriations for distribution asstate tuition support are more than required under this article, anyexcess shall revert to the state general fund. The appropriations forstate tuition support shall be made each calendar year under aschedule set by the budget agency and approved by the governor.However, the schedule must provide:
        (1) for at least twelve (12) payments;
        (2) that one (1) payment shall be made at least every forty (40)days; and
        (3) the total of the payments in each calendar year must equalthe amount required under this article.

Maximum state distribution to school corporations
    
Sec. 2. The maximum state distribution for a calendar year for allschool corporations for the purposes described in section 3 of thischapter is:
        (1) five billion eight hundred twenty-nine million nine hundredthousand dollars ($5,829,900,000) in 2009;
        (2) six billion five hundred forty-eight million nine hundredthousand dollars ($6,548,900,000) in 2010; and
        (3) six billion five hundred sixty-eight million five hundredthousand dollars ($6,568,500,000) in 2011.

Reduction in state tuition support
    
Sec. 3. If the total amount to be distributed:
        (1) as basic tuition support;
        (2) for academic honors diploma awards;
        (3) for primetime distributions;
        (4) for special education grants;
        (5) for career and technical education grants;
        (6) for restoration grants; and
        (7) for small school grants;
for a particular year exceeds the maximum state distribution for acalendar year, the amount to be distributed for state tuition supportunder this article to each school corporation during each of the lastsix (6) months of the year shall be proportionately reduced so that the

total reductions equal the amount of the excess.

Calculation of reduction amount
    
Sec. 4. The amount of the reduction for a particular schoolcorporation under section 3 of this chapter is equal to the totalamount of the excess determined under section 3 of this chaptermultiplied by a fraction. The numerator of the fraction is the amountof the distribution for state tuition support that the school corporationwould have received if a reduction were not made under this section.The denominator of the fraction is the total amount that would bedistributed for state tuition support to all school corporations if areduction were not made under this section.

Year round school; adjusted distribution
    
Sec. 5. If a school corporation operates on a twelve (12) monthschool year program, as approved by the state superintendent, thedistribution of state support for the program shall be made under anadjusted formula to be approved by the state superintendent. Theadjustment formula shall grant to each school corporation operatingan approved twelve (12) month school year an amount of money thatmust be on the same basis as the distribution for the regular supportprogram, prorated per diem to reflect the extended school term.

Adult education; transfer to fund obligations
    
Sec. 6. (a) If money appropriated in a fiscal year by the generalassembly for adult education is insufficient to fund the state adulteducation distribution formula provided in the rules adopted by thestate board, the budget agency may transfer a sufficient amount ofmoney from any excess in the state appropriation for state tuitionsupport for the fiscal year to fund the state adult educationdistribution formula.
    (b) Before the budget agency makes a transfer under this section,the budget agency shall refer the matter to the budget committee foran advisory recommendation.

Summer school education; transfer to fund obligations
    
Sec. 7. (a) If the money appropriated in a fiscal year by thegeneral assembly for summer school education is insufficient to fundthe state summer school distribution formula provided in the rulesadopted by the state board to carry out IC 20-30-7-1, the budget

agency may transfer a sufficient amount of money from any excessin the state appropriation for state tuition support for the fiscal yearto fund the state summer school distribution formula.
    (b) Before the budget agency makes a transfer under this section,the budget agency shall refer the matter to the budget committee foran advisory recommendation.
