Chapter 8. Part-Time Student Grant Program and Fund

Part-time student grant fund; administration
Sec. 1. (a) The part-time student grant fund is established to makeawards authorized under this chapter to eligible applicants.
(b) The fund consists of the following:
(1) Appropriations made by the general assembly.
(2) Gifts, grants, devises, or bequests made to the state toachieve the purposes of the fund.
(c) The fund shall be administered by the commission.
(d) The fund must be separate and distinct from other fundsadministered by the commission and money in the fund may not beexchanged with or transferred to other funds.
(e) The treasurer of state shall invest the money in the fund notcurrently needed to meet the obligations of the fund in the samemanner as other public funds are invested.
(f) Money in the fund at the end of a state fiscal year does notrevert to the state general fund but remains available to be used forproviding money for part-time student grants under this chapter.

Duties of commission
Sec. 2. The commission shall do the following:
(1) Adopt rules under IC 4-22-2 governing the operation of thefund, including rules specifying the procedures that applicantsmust follow to appeal determinations made under subdivisions(3) and (4).
(2) Prescribe the form and manner in which applications forpart-time student grants may be submitted.
(3) Determine the eligibility of applicants.
(4) Determine the amount of a part-time student grant awardedto a recipient.

Eligibility for grant
Sec. 3. An applicant is eligible to receive a part-time student grantif the following conditions are met:
(1) The applicant is domiciled in Indiana, as defined by thecommission.
(2) The applicant:
(A) has received a diploma of graduation from an approvedsecondary school;
(B) has been granted a:
(i) high school equivalency certificate before July 1, 1995;or (ii) state of Indiana general educational development(GED) diploma under IC 20-10.1-12.1 (before its repeal)or IC 20-20-6; or
(C) is a student in good standing who is completing a finalyear of study at an approved secondary school and will beeligible upon graduation to attend an approved institution ofhigher learning.
(3) The applicant declares, in writing, a specific educationalobjective or course of study and enrolls in:
(A) a course that applies toward the requirements forcompletion of that objective or course of study; or
(B) a course designed to help the applicant develop the basicskills the applicant needs to successfully achieve thatobjective or continue in that course of study.
(4) The applicant enrolls in at least two (2) but fewer thantwelve (12) credit hours in any academic term.
(5) The commission or an approved postsecondary educationalinstitution acting as the commission's agent determines that thefinancial resources available to the applicant are such that in theabsence of a grant under this chapter the applicant would bedeterred from beginning or completing the applicant's declarededucational objective or course of study.

Accumulated credit requirements
Sec. 4. The commission may establish accumulated creditrequirements as a condition of eligibility for an award made underthis chapter.

Renewal of grant
Sec. 5. Subject to this chapter, a student's part-time student grantmay be renewed if the student does the following:
(1) Makes satisfactory progress toward a certificate, nursingdiploma, associate degree, or baccalaureate degree.
(2) Demonstrates continuing financial need.

Amount of grant
Sec. 6. The commission shall determine the maximum number ofpart-time student grants available to applicants. However, withrespect to a particular student, the total of the academic terms forwhich:
(1) part-time student grants under this chapter; and
(2) Frank O'Bannon grants;
are made may not exceed the equivalent of eight (8) semesters offull-time study. The commission shall treat each academic term for
which a Frank O'Bannon grant is made as one (1) academic term.

Duties of agents
Sec. 8. The commission may permit an approved postsecondaryeducational institution to act as its agent in accepting applicationsfrom, determining eligibility for, and making awards to eligibleapplicants of the approved postsecondary educational institution. Theapproved postsecondary educational institution shall provide to thecommission on a timely basis any information, reports, andaccounting the commission requires.
