    Chapter 5. Tuition Exemption for Senior Citizens

Senior citizens tuition fund; establishment
    
Sec. 1. (a) The senior citizens tuition fund is established toprovide full or partial reimbursements to state educationalinstitutions for the amount of tuition waived under this chapter.
    (b) The fund shall be administered by the commission.
    (c) The expenses of administering the fund shall be paid frommoney in the fund.
    (d) The treasurer of state shall invest the money not currentlyneeded to meet the obligations of the fund in the same manner asother public funds may be invested.

Duties of state educational institutions
    
Sec. 2. Except as provided in section 4 of this chapter, a stateeducational institution shall:
        (1) admit a senior citizen to a scheduled course where there isspace available; and
        (2) grant a waiver of the tuition assessed for the course asprovided in section 3 of this chapter.

Amount of tuition
    
Sec. 3. The amount of the tuition waived under section 2 of thischapter must equal fifty percent (50%) of the in-state tuition assessedfor the course by the state educational institution.

Requirements of state educational institutions
    
Sec. 4. A state educational institution is not required to do thefollowing:
        (1) Allow a senior citizen to enroll in a degree grantingprogram, unless the senior citizen meets the admissionstandards of the institution.
        (2) Permit the full-time equivalent enrollment of senior citizensfor whom tuition has been waived to exceed two percent (2%)of the institution's undergraduate full-time equivalentenrollment.
        (3) Waive a senior citizen's tuition for more than the equivalentof nine (9) semester hours per semester.
        (4) Waive fees for self-supporting programs, applications,registration, or laboratory work.

Additional duties of state educational institutions
    
Sec. 5. (a) A state educational institution may receive areimbursement from the fund for an amount equal to:
        (1) the amount of total tuition waived under this chapter; or
        (2) if the amount in the fund is insufficient to cover the tuitionwaivers for all of the institutions, a pro rata reduction of theamount of total tuition waivers based upon the number of seniorcitizens for which the institution provides tuition waiverscompared to the total number of senior citizens who participateunder this chapter statewide.
    (b) To receive a reimbursement under subsection (a), the stateeducational institution must apply to the commission, on formsprovided by the commission, for the reimbursement.

Comprehensive report
    
Sec. 6. (a) In addition, not later than thirty (30) days after the endof each semester (or its equivalent if the state educational institutiondoes not conduct its academic year on a semester basis), each stateeducational institution shall provide the commission and thecommission for higher education with a comprehensive reportdetailing the extent to which the institution participated in the seniorcitizen tuition exemption under this chapter.
    (b) The report must include the following information:
        (1) The number of senior citizens who qualified for a tuitionexemption.
        (2) The courses in which the senior citizens enrolled.
        (3) The number of semester hours (or its equivalent) taken bysenior citizens under this chapter.
        (4) Any other pertinent information required by thecommission.

Additional educational opportunities
    
Sec. 7. This chapter does not prohibit a state educationalinstitution from offering other educational opportunities that are notcovered by this chapter to senior citizens at no charge or at a reducedcharge.
