    Chapter 6. Tuition and Fee Exemption for Children and SurvivingSpouse of Public Safety Officers Killed in the Line of Duty

Applicability
    
Sec. 1. This chapter applies to the children and surviving spouseof a public safety officer if the public safety officer was a resident ofIndiana when killed in the line of duty.

Eligibility; children of slain public safety officers
    
Sec. 2. (a) This section applies to a public safety officer's childwho is less than twenty-four (24) years of age on the date of thepublic safety officer's death. The children of a public safety officerwho has been killed in the line of duty are exempt from the paymentof tuition and regularly assessed fees for eight (8) semesters (or theequivalent) in which the children enroll at a state educationalinstitution or state supported technical school. The children must befull-time students pursuing a prescribed course of study.
    (b) The maximum amount that an eligible applicant is exemptfrom paying for a semester hour is an amount equal to the cost of anundergraduate semester credit hour at the state educational institutionin which the eligible applicant enrolls.

Eligibility; surviving spouse of public safety officers
    
Sec. 3. The surviving spouse of a public safety officer who hasbeen killed in the line of duty is not required to pay educational costsat a state educational institution or state supported technical school,as long as the surviving spouse is pursuing a prescribed course ofstudy at the institution towards an undergraduate degree.

Amount of benefits
    
Sec. 4. The amount of the benefits under this chapter is equal toone (1) of the following amounts:
        (1) If an eligible applicant does not receive financial assistancespecifically designated for educational costs, the amountdetermined under section 2 or 3 of this chapter that is applicableto the eligible applicant.
        (2) If an eligible applicant receives financial assistancespecifically designated for educational costs:
            (A) the amount determined under section 2 or 3 of thischapter that is applicable to the eligible applicant; minus
            (B) the financial assistance specifically designated foreducational costs.As added by P.L.2-2007, SEC.255.
