    ARTICLE 17. POSTSECONDARY PROPRIETARYEDUCATIONAL INSTITUTIONS AND OTHERPRIVATE EDUCATIONAL INSTITUTIONS

    Chapter 1. General Provisions; Definitions

Definitions
    
Sec. 1. The definitions in this chapter apply throughout thisarticle.

IC 21-17-1-2
"Accreditation"
    
Sec. 2. "Accreditation" means certification of a status of approvalor authorization by the commission to conduct business as apostsecondary proprietary educational institution.

IC 21-17-1-3
"Agent"
    
Sec. 3. "Agent" means a person who:
        (1) enrolls or seeks to enroll a resident of Indiana through:
            (A) personal contact;
            (B) telephone;
            (C) advertisement;
            (D) letter; or
            (E) publications;
        in a course offered by a postsecondary proprietary educationalinstitution; or
        (2) otherwise holds the person out to the residents of Indiana asrepresenting a postsecondary proprietary educational institution.

IC 21-17-1-4
"Agent's permit"
    
Sec. 4. "Agent's permit" means a nontransferable writtenauthorization issued to a person by the commission to solicit aresident of Indiana to enroll in a course offered or maintained by apostsecondary proprietary educational institution.

"Application"
    
Sec. 5. "Application" means a written request for accreditation oran agent's permit on forms supplied by the commission.

"Commission"
    
Sec. 6. "Commission" means the Indiana commission onproprietary education.

IC 21-17-1-7
"Course"
    
Sec. 7. "Course" means a plan or program of instruction ortraining, whether conducted in person, by mail, or by any othermethod.

IC 21-17-1-8
"Fund"
    
Sec. 8. "Fund" refers to the career college student assurance fundestablished by IC 21-17-3-8.

IC 21-17-1-9
"Municipality"
    
Sec. 9. "Municipality" means a city or town that, under theauthority in IC 36-7 and through its redevelopment commission, mayundertake and carry out redevelopment or urban renewal projects.

IC 21-17-1-10
"Nonprofit college or university"
    
Sec. 10. "Nonprofit college or university", for purposes ofsections 14 and 17 of this chapter and IC 21-17-6, refers to apostsecondary educational institution described in IC 21-17-6-1.

IC 21-17-1-11
"Person"
    
Sec. 11. "Person" means an individual, a partnership, a limitedliability company, an association, a corporation, a joint venture, atrust, a receiver, or a trustee in bankruptcy.

"Police officer"
    
Sec. 12. "Police officer" refers to a police officer who:
        (1) is appointed under IC 21-17-5; and
        (2) is not employed by a state educational institution.

IC 21-17-1-13
"Postsecondary proprietary educational institution"
    
Sec. 13. "Postsecondary proprietary educational institution"

means a person doing business in Indiana by offering to the publicfor a tuition, fee, or charge, instructional or educational services ortraining in a technical, professional, mechanical, business, orindustrial occupation, either in the recipient's home, at a designatedlocation, or by mail. The term does not include the following:
        (1) A state educational institution or another educationalinstitution established by law and financed in whole or part bypublic funds.
        (2) A postsecondary proprietary educational institutionapproved or regulated by any other state regulatory board,agency, or commission other than the Indiana commission onproprietary education.
        (3) An elementary or secondary school attended by students inkindergarten or grades 1 through 12, supported in whole or inpart by private tuition payments.
        (4) Any educational institution or educational training that:
            (A) is maintained or given by an employer or a group ofemployers, without charge, for employees or for individualsthe employer anticipates employing;
            (B) is maintained or given by a labor organization, withoutcharge, for its members or apprentices;
            (C) offers exclusively instruction that is clearlyself-improvement, motivational, or avocational in intent(including instruction in dance, music, self-defense, andprivate tutoring); or
            (D) is a Montessori or nursery school.
        (5) A privately endowed two (2) or four (4) year degreegranting institution, regionally accredited, whose principalcampus is located in Indiana.

IC 21-17-1-14
"Private redevelopment corporation"
    
Sec. 14. "Private redevelopment corporation" means:
        (1) a corporation that is wholly owned or controlled by one (1)or more nonprofit colleges or universities; or
        (2) a corporation that operates on behalf of a nonprofit collegeor university on a nonprofit basis.

IC 21-17-1-15
"Private technical, vocational, correspondence, and trade school"
    
Sec. 15. "Private technical, vocational, correspondence, and tradeschool" means an institution or agency offering course or courses ofinstruction for a fee or fees and that is not primarily supported bypublic tax funds. The term does not include the following:
        (1) A college or university offering a course of study leading toa bachelor's degree.
        (2) A nonpublic preschool, elementary, or secondary school thatis approved by the department of education.As added by P.L.2-2007, SEC.258.

"Project area"
    
Sec. 16. "Project area" means:
        (1) a slum area; or
        (2) an area needing redevelopment (as defined in IC 36-7-1-3).

IC 21-17-1-17
"Qualified entity"
    
Sec. 17. "Qualified entity" means either of the following:
        (1) A nonprofit college or university.
        (2) A private redevelopment corporation.

IC 21-17-1-18
"Redevelopment plan"
    
Sec. 18. "Redevelopment plan" means a plan proposed by aqualified entity for the redevelopment and renewal of a project areafor educational uses.
