Indiana commission on proprietary education; established
Sec. 1. The Indiana commission on proprietary education isestablished.

Members
Sec. 2. (a) The commission consists of the following seven (7)members:
(1) The state superintendent or the superintendent's designee.
(2) The executive officer of the commission for highereducation or the executive officer's designee.
(3) Five (5) members appointed by the governor.
(b) The members appointed by the governor under subsection (a)serve for a term of four (4) years.
(c) Not more than three (3) of the members appointed by thegovernor may be members of one (1) political party.
(d) Of the five (5) members appointed by the governor:
(1) one (1) must have been engaged for a period of at least five(5) years immediately preceding appointment in an executive ora managerial position in a postsecondary proprietaryeducational institution subject to IC 21-17-3;
(2) one (1) must have been engaged in administering ormanaging an industrial employee training program for a periodof at least five (5) years immediately preceding appointment;and
(3) three (3) must be representatives of the public at large whoare not representatives of the types of postsecondary proprietaryeducational institutions to be accredited.
For purposes of subdivision (3), an elected or appointed state or localofficial or a member of a private or public school may not beappointed as a representative of the public at large.
(e) An appointment to fill a vacancy occurring on the commissionis for the unexpired term.

Member salary and benefits
Sec. 3. (a) A member of the commission who is not a stateemployee is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). The member is also entitled to reimbursement fortraveling expenses as provided under IC 4-13-1-4 and other expensesactually incurred in connection with the member's duties as providedin the state policies and procedures established by the Indianadepartment of administration and approved by the budget agency.
(b) Each member of the commission who is a state employee is
entitled to reimbursement for traveling expenses as provided underIC 4-13-1-4 and other expenses actually incurred in connection withthe member's duties as provided in the state policies and proceduresestablished by the Indiana department of administration andapproved by the budget agency.

Officers and staff; meetings
Sec. 4. (a) The commission may select officers from thecommission's membership as the commission considers necessary.
(b) The commission may employ and fix compensation fornecessary administrative staff.
(c) The commission may adopt reasonable rules under IC 4-22-2to implement this chapter and IC 21-17-3.
(d) The commission:
(1) may meet as often as is necessary upon call of thechairperson; and
(2) shall meet at least four (4) times a year.
(e) The commission may adopt and use a seal, the description ofwhich shall be filed with the office of the secretary of state, andwhich may be used for the authentication of the acts of thecommission.
