Chapter 6. Regional Institutes; Regional Board of Trustees

Trustees; powers and duties; establishment of regions
Sec. 1. The state board of trustees may do the following:
(1) Divide Indiana into appropriate regions, taking intoconsideration, but not limited to, factors such as population,potential enrollment, tax bases, and driving distances, anddevelop an overall state plan that provides for the orderlydevelopment of the regions encompassing, ultimately, all partsof Indiana into a coordinated system providing a comprehensiveprogram of post-high school general, liberal arts, occupational,and technical education.
(2) Whenever a region is established, issue a charter, in a formthat the state board of trustees provides, to the region, assist andsupervise the development of a regional plan, and coordinateregional programs to avoid unnecessary and wastefulduplication.
(3) Make biennial studies of the budget requirements of theregions and of its own programs and prepare a budget, includinganticipated revenues and providing for the construction or rentalof facilities requisite to carrying out the needs of Ivy TechCommunity College.
(4) Perform or contract for the performance of periodic auditsof the financial records of each region.

Regional board; appointment
Sec. 2. Whenever the state board of trustees establishes anadministrative region, it shall appoint a regional board of trustees.

Regional board; membership
Sec. 3. The regional board of a region consists of at least seven (7)members, including at least five (5) members who are representativeof the manufacturing, commercial, agricultural, labor, andeducational groups of the region, all appointed by the state board oftrustees. All members of the regional board must be residents of theregion. Appointments are for three (3) year terms, on a staggeredbasis, and all trustees must be citizens of Indiana. Members mayserve for an unlimited number of terms.

IC 21-22-6-4 Regional board; vacancies
Sec. 4. A vacancy on the regional board shall be filled byappointment by the state board of trustees. The regional board shallnominate and submit to the state board the names of one (1) or morecandidates to fill the vacancy within forty (40) days after the vacancyoccurs. The state board of trustees may appoint one (1) of thepersons nominated by the regional board or may reject all of theregional board's nominees. If the state board of trustees rejects all ofthe nominees from a regional board, the state board of trustees shallnotify the regional board, and the regional board shall make one (1)or more additional nominations within forty (40) days after receiptof the notice. The state board of trustees shall then fill the vacancyfrom either the original group of nominations or from the additionalnominations.

Regional board of trustees; election of officers
Sec. 5. The members of the regional board shall annually elect achairman, a vice chairman, and a secretary.

Regional board of trustees; meetings
Sec. 6. Meetings of the regional board shall be called in such amanner and at such times, and shall operate under such rules, as theregional board may prescribe. The regional board shall meet at leastfour (4) times annually.

Regional board; quorum; votes
Sec. 7. A majority of the regional board constitutes a quorum. Theaffirmative votes of a majority of the regional board are required forthe board to take action on any matter.

Regional board; duties
Sec. 8. A regional board shall do the following:
(1) Make a careful analysis of the educational needs andopportunities of the region.
(2) Develop and recommend to the state board of trustees a planfor providing postsecondary:
(A) general education;
(B) liberal arts education; and
(C) occupational and technical education;
programs and appropriate workforce development, assessment,
and training services for the residents of that region.
(3) Develop and recommend a budget for regional programs andoperations.
(4) Identify and recommend alternative methods of acquiring orsecuring facilities and equipment necessary for the delivery ofeffective regional programs.
(5) Facilitate and develop regional cooperation with employers,community leaders, economic development efforts, area careerand technical education centers, and other public and privateeducation and training entities in order to providepostsecondary general, liberal arts, and occupational andtechnical education and training in an efficient and costeffective manner and to avoid duplication of services.
(6) Determine through evaluation, studies, or assessments thedegree to which the established training needs of the region arebeing met.
(7) Make recommendations to the state board of trusteesconcerning policies that appear to substantially affect theregional board's capacity to deliver effective and efficientprogramming.

Sec. 9. A regional board may do the following:
(1) Adopt, amend, or repeal bylaws for the region, subject to theapproval of the state board of trustees.
(2) Make recommendations to the state board of trusteesconcerning amendments to the charter of the region.

State board; recommendations
Sec. 10. Before taking any action under IC 21-27-6-3,IC 21-27-6-4, IC 21-31-2-5, IC 21-38-3-7(2), or IC 21-41-5-8 thatwould substantially affect a region, the state board of trustees shallrequest recommendations concerning the proposed action from theregional board for that region.

Public hearings concerning recommendations of regional board
Sec. 11. Upon request of a regional board that has submittedrecommendations under section 8(7) or 10 of this chapter, the stateboard of trustees shall conduct public hearings concerning therecommendations at a regular or special meeting of the state boardof trustees.As added by P.L.2-2007, SEC.263.
