Chapter 2. Equal Education Opportunity

Policy
Sec. 1. The following is the public policy of the state:
(1) To provide:
(A) equal;
(B) nonsegregated; and
(C) nondiscriminatory;
educational opportunities and facilities for all, regardless ofrace, creed, national origin, color, or sex.
(2) To provide and furnish state educational institutions openequally to all, and prohibited and denied to none because ofrace, creed, color, or national origin.
(3) To reaffirm the principles of:
(A) the Bill of Rights;
(B) civil rights; and
(C) the Constitution of the State of Indiana.
(4) To provide a uniform democratic system of public educationto the state and the citizens of Indiana.
(5) To:
(A) abolish;
(B) eliminate; and
(C) prohibit;
segregated and separate departments or divisions of a stateeducational institution on the basis of race, creed, or color.
(6) To eliminate and prohibit:
(A) segregation;
(B) separation; and
(C) discrimination;
on the basis of race, color, or creed in state educationalinstitutions.

Supplemental effect of chapter
Sec. 2. This chapter is supplemental to:
(1) all common law, statutory law, and civil rights applicable tostate educational institutions; and
(2) the rights and remedies arising from these laws of the stateand to the citizens of Indiana.

State educational institutions open to all
Sec. 3. State educational institutions are open to all children untilthe children complete their courses of study, subject to the authorityvested in the state educational institutions by law.

Segregation prohibited
Sec. 4. (a) The board of trustees of a state educational institutionmay not build or erect, establish, maintain, continue, or permit anysegregated or separate state educational institutions on the basis ofrace, color, creed, or national origin of students.
(b) The officials described in subsection (a) may take anyaffirmative actions that are reasonable, feasible, and practical toeffect greater integration and to reduce or prevent segregation orseparation of races in state educational institutions for whatevercause, including:
(1) site selection; or
(2) revision of:
(A) districts;
(B) curricula; or
(C) enrollment policies;
to implement equalization of educational opportunity for all.

Segregation prohibited; pupils
Sec. 5. (a) A student may not be prohibited, segregated, or deniedattendance or enrollment to a state educational institution because ofthe student's race, creed, color, or national origin.
(b) Every student is free to attend a state educational institutionwithin the laws applicable alike to noncitizen and nonresidentstudents.

Segregation prohibited; state educational institutions
Sec. 6. (a) A state educational institution may not segregate,separate, or discriminate against any of its students on the basis ofrace, creed, or color.
(b) Admission to a state educational institution may not beapproved or denied on the basis of race, creed, or color.

Sec. 7. A state educational institution may not discriminate in anyway in the hiring, upgrading, tenure, or placement of any teacher onthe basis of race, creed, color, or national origin.
