Chapter 4. Postsecondary Enrollment Program

Applicability
Sec. 1. This chapter applies to a program at:
(1) a state educational institution; or
(2) any other eligible institution.

Actions not prohibited
Sec. 2. This chapter does not prohibit:
(1) a student from enrolling in or attending an educationprogram when the student is not required to be in attendance atthe student's school corporation;
(2) a school corporation from:
(A) providing a supplemental postsecondary educationprogram to students; and
(B) permitting a student to attend an education programduring the regular school day or regular school year; or
(3) an eligible institution from permitting a student of a schoolcorporation to enroll in or attend a course offered or sponsoredby the eligible institution.

Program establishment
Sec. 3. The postsecondary enrollment program is established forsecondary school students in grades 11 and 12.

Enrollment in courses
Sec. 4. A student may enroll in courses offered by an eligibleinstitution under the program on a full-time or part-time basis duringgrade 11 or grade 12, or both.

Credits
Sec. 5. If a school corporation has approved a course offered byan eligible institution for secondary credit, a student is entitled tocredit toward graduation requirements for each course the studentsuccessfully completes at the eligible institution.

Information concerning program
Sec. 6. Before February 1 each year, each school corporation shall
provide each student in grades 10 and 11 with informationconcerning the program.

Students; notice of intent to enroll in program
Sec. 7. A student who intends to enroll in an eligible institutionunder the program shall notify the principal of the school in whichthe student is enrolled.

Preenrollment meeting with student
Sec. 8. A representative of the school corporation shall meet witheach student who intends to participate in the program and discussthe following:
(1) The courses in which the student may enroll.
(2) The postsecondary credit the student earns upon successfulcompletion of a course.
(3) The consequences of the student's failure to successfullycomplete a course.
(4) The student's schedule.
(5) The financial obligations of the student and the school underthe program.
(6) The responsibilities of the student, the student's parent, andthe school under the program.
(7) Other matters concerning the program.

Governing body; adoption of policies to implement program
Sec. 9. The governing body of each school corporation shall:
(1) adopt policies to implement the program, based onguidelines established by the department of education; and
(2) work with eligible institutions to grant secondary credits toa student who attends a postsecondary institution while thestudent also is attending secondary school.

Application for enrollment in eligible institution; admission
Sec. 10. A student may apply for enrollment to an eligibleinstitution. The eligible institution shall accept or reject the studentbased on the standards ordinarily used to decide student enrollments.However, a student in the program may not be refused admissionsolely because the student has not graduated from a secondaryschool.

Sec. 11. The eligible institution shall promptly inform the:
(1) student;
(2) student's principal; and
(3) department of education;
of the decision under section 10 of this chapter.

Financial assistance
Sec. 12. Upon demonstration of financial need, an eligibleinstitution may grant financial assistance to a student accepted foradmission to the eligible institution.

Dual credit contracts
Sec. 13. If a student enrolls in a course offered by an eligibleinstitution under the program, the eligible institution and thestudent's school corporation shall enter into a contract for dual credit.The contract must establish the terms and conditions under which:
(1) the eligible institution will award credit for specified classessuccessfully completed by students in the school corporation;and
(2) the school corporation will award credit for specified classessuccessfully completed by students at the eligible institution.

Secondary credits
Sec. 14. A school corporation shall grant secondary credit for acourse successfully completed by a student at an eligible institutionif the school corporation approved the course for secondary credit.The student's school records must reflect that the secondary creditswere earned at an eligible institution.

Postsecondary credits
Sec. 15. If a student enrolls in an eligible institution aftergraduation from secondary school, the eligible institution shall awardpostsecondary credit for a course successfully completed by thestudent at the eligible institution. If the student enrolls in anothereligible institution, that eligible institution may grant credit forcourses successfully completed by the student.

List of students and courses
Sec. 16. At the end of each school year, each school corporation
shall submit to the department of education the following:
(1) A list of the students in the school corporation who areenrolled in the program.
(2) A list of the courses successfully completed by each studentwho is enrolled in the program.

Secondary schools; records
Sec. 17. (a) A school corporation shall make and maintain, foreach student enrolled in the program, records of the following:
(1) The courses and credit hours in which the student enrolls.
(2) The courses that the student successfully completes and failsto complete.
(3) The secondary credit granted to the student.
(4) Other information requested by the department of education.
(b) The department of education is entitled to have access to therecords made and maintained under subsection (a).

Eligible institutions; records
Sec. 18. (a) An eligible institution shall make and maintain, foreach student enrolled in the program, records of the following:
(1) The courses in which the student enrolls and the credit hoursawarded for those courses.
(2) The courses that the student successfully completes and thecourses that the student fails to complete.
(3) The postsecondary credit granted to the student.
(4) Other information requested by the commission for highereducation.
(b) The commission for higher education is entitled to have accessto the records made and maintained under subsection (a).

Duties of department
Sec. 19. (a) The department of education, in consultation with thecommission for higher education, shall:
(1) establish guidelines to carry out this chapter; and
(2) evaluate the program annually and report to the Indiana stateboard of education concerning the program.
(b) The guidelines established under this section must encourageparticipation by students:
(1) at all achievement levels; and
(2) in a variety of academic and vocational subjects.

Adoption of rules Sec. 20. The:
(1) Indiana state board of education; and
(2) commission for higher education;
shall adopt rules under IC 4-22-2 to carry out this chapter.
