Chapter 16. Fire Safety Emergency Signs

"Owner" defined
Sec. 1. As used in this chapter, "owner" means a person havingcontrol or custody of any building covered by this chapter.

Rules; adoption; application
Sec. 2. (a) The fire prevention and building safety commissionshall adopt rules under IC 4-22-2 governing fire safety in certainbuildings as specified in subsection (b).
(b) Except as provided in subsection (c) and subsection (d), thischapter and the rules adopted under it apply to:
(1) all hotels, motels, apartments (in buildings containing three(3) or more apartments), and buildings containing three (3) ormore sleeping rooms that rent for a fee; and
(2) all buildings occupied after September 14, 1982, as hotels,motels, apartments (in buildings containing three (3) or moreapartments), and buildings containing three (3) or more sleepingrooms that rent for a fee.
(c) This chapter does not apply to hotels and motels that have nointerior corridors and whose individual rooms have only exteriorexits.
(d) This chapter does not apply to an apartment in an apartmentbuilding from which apartment there is immediate ground levelaccess to the outside.
(e) Compliance with this chapter and the rules adopted under itdoes not relieve the owner of a building covered by this chapter fromthe requirements of any other applicable law, rule, regulation, orordinance.

Rules; contents
Sec. 3. (a) The rules required by this chapter must include thefollowing requirements:
(1) In all hotels, motels, and buildings containing three (3) ormore sleeping rooms that rent for a fee, an emergency sign mustbe permanently affixed to the back of each guestroom or roomdoor and by the entrance to a required exitway where there is aninterior door with corridors to the exitway.
(2) In all apartments covered by this chapter, an emergency signmust be permanently affixed in a prominent location.
(b) The emergency signs required by subsection (a) must containthe following information:
(1) Instructions on practical emergency procedures in case of
fire or other emergency.
(2) In hotels, motels, and buildings containing three (3) or moresleeping rooms that rent for a fee only, a statement describingthe number of doors (to the left or right) to a fire exit.
(c) In addition, the rules required by this chapter must includerequirements for the letter size, color, content, location, and overallsize of the emergency signs required by this chapter.

Violation; offense
Sec. 4. An owner violating the provisions of this chapter or therules adopted under it, commits a Class A infraction.

Inspections to determine compliance
Sec. 5. The state fire marshal's office shall, as part of its normalinspection process, conduct inspections to determine if there iscompliance with this chapter and the rules adopted under it. Anyevidence of a violation shall be turned over to the prosecutingattorney of the county where the violation occurred.
