Establishment of commission
    
Sec. 1. The fire prevention and building safety commission isestablished.

Membership
    
Sec. 2. (a) The commission consists of eleven (11) members, nine(9) of whom shall be appointed by the governor.
    (b) The term of a commission member is four (4) years.
    (c) The state health commissioner or the commissioner's designeeshall serve as a member of the commission, and the commissioner oflabor or the commissioner's designee shall serve as a member of thecommission.
    (d) Each appointed member of the commission must have arecognized interest, knowledge, and experience in the field of fireprevention, fire protection, building safety, or other related matters.The governor shall consider appointing individuals to thecommission with experience in the following:
        (1) A paid fire department.
        (2) A volunteer fire department.
        (3) The field of fire insurance.
        (4) The fire service industry.
        (5) The manufactured housing industry.
        (6) The field of fire protection engineering.
        (7) As a professionally licensed engineer.
        (8) Building contracting.
        (9) The field of building one (1) and two (2) family dwellings.
        (10) As a professionally licensed architect.
        (11) The design or construction of heating, ventilating, airconditioning, or plumbing systems.
        (12) The design or construction of regulated lifting devices.
        (13) City, town, or county building inspection.
        (14) Regulated amusement devices.
        (15) Accessibility requirements and personal experience witha disability.
        (16) Underground and aboveground motor fuel storage tanksand dispensing systems.
        (17) The masonry trades.
        (18) Energy conservation codes and standards, including themanner in which energy conservation codes and standards applyto:
            (A) residential;
            (B) single and multiple family dwelling; or
            (C) commercial;
        building codes.    (e) Not more than five (5) of the appointed members of thecommission may be affiliated with the same political party.

Removal of member
    
Sec. 3. The governor may remove a member of the commissionfor inefficiency or neglect of duty.

Vacancies; appointment
    
Sec. 4. If a vacancy occurs on the commission, the governor shallappoint an individual to serve the unexpired term of the vacatingmember.

Commission chair
    
Sec. 5. (a) The governor shall appoint a member of thecommission to be the commission's chair.
    (b) The member appointed by the governor serves as thecommission's chair at the governor's pleasure.

Meetings; quorum; actions
    
Sec. 6. (a) The commission shall meet at least quarterly.
    (b) A quorum of the commission consists of six (6) members.IC 4-21.5-3-3 applies to a commission action governed by IC 4-21.5.

Facilities and staff
    
Sec. 7. The department shall provide facilities and staff to carryout the responsibilities of the commission.

Per diem; expenses
    
Sec. 8. (a) Each member of the commission who is not a stateemployee is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). Such a member is also entitled to reimbursementfor traveling expenses and other expenses actually incurred inconnection with the member's duties, as provided in the state travel

policies and procedures established by the department ofadministration and approved by the state budget agency.
    (b) Each member of the commission who is a state employee isentitled to reimbursement for travel expenses and other expensesactually incurred in connection with the member's duties, as providedin the state travel policies and procedures established by thedepartment of administration and approved by the state budgetagency.
