    Chapter 3. Board of Firefighting Personnel Standards andEducation

Establishment of board
    
Sec. 1. The board of firefighting personnel standards andeducation is established.

Membership
    
Sec. 2. (a) The education board consists of eleven (11) votingmembers as follows:
        (1) The state fire marshal or the state fire marshal's designee.
        (2) The director of the department's division of preparednessand training or the director's designee.
        (3) Nine (9) members appointed by the governor, each servinga four (4) year term.
    (b) Each appointed member of the education board must bequalified by experience or education in the field of fire protectionand related fields.
    (c) Each appointed member of the education board must be aresident of Indiana.
    (d) The education board must include the following appointedmembers:
        (1) Seven (7) individuals who are members of fire departments.Appointments under this subdivision must include thefollowing:
            (A) At least one (1) individual who is a full-time firefighter(as defined in IC 36-8-10.5-3).
            (B) At least one (1) individual who is a volunteer firefighter(as defined in IC 36-8-12-2).
            (C) At least one (1) individual who is a fire departmentofficer.
        (2) Two (2) citizens who are not members of a fire department.

Removal of members
    
Sec. 3. The governor may remove a member of the educationboard for inefficiency or neglect of duty.

Vacancies; appointment
    
Sec. 4. If a vacancy occurs on the education board, the governorshall appoint an individual to serve the unexpired term of thevacating member.As added by P.L.245-1987, SEC.1.

Chairperson; vice chairperson; secretary
    
Sec. 5. The education board shall annually elect a chairperson, avice chairperson, and a secretary from among its members.

Meetings; quorum; actions
    
Sec. 6. (a) The education board shall meet as it determinesnecessary.
    (b) Meetings of the education board shall be called upon therequest of its chairperson or the written request of five (5) of itsmembers.
    (c) Meetings of the education board must be held in Indiana.
    (d) A quorum of the education board consists of five (5) votingmembers. IC 4-21.5-3-3 applies to an education board actiongoverned by IC 4-21.5. The education board may take other actionsby an affirmative vote of:
        (1) five (5) members, if less than ten (10) members are presentand voting on the action; or
        (2) six (6) members, if ten (10) members are present and votingon the action.

Facilities and staff
    
Sec. 7. The division of fire and building safety shall providefacilities and staff to carry out the responsibilities of the educationboard.

Per diem; expenses
    
Sec. 8. (a) Each member of the education board who is not a stateemployee is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b) for attendance at meetings of the education boardwhere at least a quorum of its members are present, unless themember is a state employee. Such a member of the education boardis also entitled to reimbursement for travel expenses and otherexpenses actually incurred in connection with attending a meeting ofthe education board where at least a quorum of its members arepresent, as provided in the state travel policies and proceduresestablished by the department of administration and approved by thestate budget agency.
    (b) Each member of the education board who is a state employeeis entitled to reimbursement for travel expenses and other expensesactually incurred in connection with the member's duties, as provided

in the state travel policies and procedures established by thedepartment of administration and approved by the state budgetagency.
