    Chapter 4.5. Regulated Amusement Device Safety Board

"Board" defined
    
Sec. 1. As used in this chapter, "board" refers to the regulatedamusement device safety board established by section 2 of thischapter.

Sec. 2. The regulated amusement device safety board isestablished.

Membership
    
Sec. 3. (a) The board has eleven (11) members, appointed asfollows:
        (1) The chief inspector of the division of elevator safety or thechief inspector's designee.
        (2) One (1) individual who represents an insurance companythat insures regulated amusement devices, appointed by thegovernor.
        (3) One (1) individual who is a carnival owner, appointed by thegovernor.
        (4) One (1) individual who represents a state or county fairorganization, appointed by the governor.
        (5) One (1) individual who represents a manufacturer ofregulated amusement devices, appointed by the governor.
        (6) One (1) individual who represents an amusement park,appointed by the governor.
        (7) One (1) individual who represents festival or eventorganizers, appointed by the governor.
        (8) One (1) professional engineer, appointed by the governor.
        (9) Three (3) individuals who represent the general public,appointed as follows:
            (A) The governor shall appoint one (1) individual.
            (B) The speaker of the house of representatives shall appointone (1) individual.
            (C) The president pro tempore of the senate shall appointone (1) individual.
    (b) Each member appointed under subsection (a) must be aresident of Indiana.

Term of office; vacancies
    
Sec. 4. (a) The term of a member is three (3) years. A member

continues to serve until the member's successor is appointed.
    (b) The appointing authority may remove a member of the boardfor inefficiency or neglect of duty.
    (c) If a vacancy occurs on the board, an individual appointed tofill the vacancy serves the unexpired term of the vacating member.

Chairperson and vice chairperson
    
Sec. 5. The board shall annually elect a chairperson and vicechairperson from among the board's members.

Meetings; quorum
    
Sec. 6. (a) The board shall meet at least quarterly.
    (b) A quorum of the board consists of six (6) members. Theaffirmative votes of at least six (6) members of the board are requiredfor the board to take action.

Expenses
    
Sec. 7. (a) Each member of the board who is not a state employeeis not entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). The member is, however, entitled toreimbursement for traveling expenses as provided under IC 4-13-1-4and other expenses actually incurred in connection with the member'sduties as provided in the state policies and procedures established bythe Indiana department of administration and approved by the budgetagency.
    (b) Each member of the board who is a state employee is entitledto reimbursement for traveling expenses as provided underIC 4-13-1-4 and other expenses actually incurred in connection withthe member's duties as provided in the state policies and proceduresestablished by the Indiana department of administration andapproved by the budget agency.

Facilities and staff
    
Sec. 8. The department shall provide facilities and staff to carryout the responsibilities of the board.
