Chapter 9. Heating Oil Tank Closure

"Heating oil tank" defined
Sec. 1. As used in this chapter, "heating oil tank" means an aboveground or underground tank used to store heating oil for use as a fuelin heating a residential property.

Duties of owners
Sec. 2. (a) Immediately upon abandoning the use of heating oil asa fuel in heating a property, the owner of a heating oil tank, underapplicable state and federal law, shall:
(1) remove all flammable or combustible liquids from theheating oil tank, piping, and connections; and
(2) except as provided under subsection (b), remove the outsidefilling pipe.
(b) An owner is not required to remove an outside filling pipeunder subsection (a)(2) if the owner permanently secures the tankagainst accidental filling.
(c) An owner of a heating oil tank described in subsection (a)shall, under applicable state and federal law, dispose of allflammable and combustible liquids removed under subsection (a).

Duties of contractors or subcontractors
Sec. 3. A contractor or subcontractor proposing to convert aresidential property from heating oil to another heat source shallinform the property owner of the requirements of this chapter andinclude in a contract for labor and materials the cost of:
(1) properly removing and disposing of all flammable orcombustible liquids from a heating oil tank; and
(2) either:
(A) removing an outside filling pipe; or
(B) permanently securing the tank against accidental filling.
