    Chapter 10. Ban on Employer Waiver of Liability

Negligence; employer; liability for damages
    
Sec. 1. All contracts between employer and employee releasingthe employer from liability for damages arising out of the negligenceof the employer by which the employee is injured, or, in case of theemployee's death, to his representative, are against public policy, andhereby declared null and void.

Sec. 2. All contracts between employer and employee releasingthird persons, copartnerships or corporations from liability fordamages arising out of the negligence of such third persons,copartnerships or corporations by which the employee of suchemployer is injured, or in case of the death of such employee, to hisrepresentative, are against public policy and are hereby declared nulland void.

Sec. 3. All contracts between an employee and a third person,copartnership, or corporation in which it is agreed that the employerof such employee shall be released from liability for damages of suchemployee arising out of the negligence of the employer, or in case ofthe death of such employee to his representative, are against publicpolicy and are hereby declared null and void; provided, that nothingin this chapter shall apply to voluntary relief departments orassociations organized for the purpose of insuring employees.Nothing in this chapter shall be construed to revert back to contractsmade prior to March 11, 1901. Nor shall this chapter affect litigationpending on March 11, 1901; provided, that nothing in any section ofthis chapter shall be so construed as to affect or apply to any contractor agreement that may be made between the employer and employee,or in case of death his next of kin or his representative after an injuryto the employee has occurred, but the provisions of this chapter shallapply solely to contracts made prior to any injury.
