    Chapter 13. Indiana Commission for Career and TechnicalEducation

"Commission"
    
Sec. 1. As used in this chapter, "commission" refers to the Indianacommission for career and technical education of the departmentestablished by section 6 of this chapter.

Sec. 2. As used in this chapter, "council" refers to the stateworkforce innovation council established by IC 22-4-18.1-3.

"Employment training"
    
Sec. 3. As used in this chapter, "employment training" means allprograms administered by the following:
        (1) The council.
        (2) The Indiana jobs training program.
        (3) The department.

"Career and technical education"
    
Sec. 5. As used in this chapter, "career and technical education"means any vocational, agricultural, occupational, manpower,employment, or technical training or retraining that:
        (1) enhances an individual's career potential and furthereducation; and
        (2) is accessible to individuals who desire to explore and learnfor economic and personal growth leading to employmentopportunities.

Commission established; membership
    
Sec. 6. (a) The Indiana commission for career and technicaleducation is established within the department.    (b) The commission consists of eleven (11) citizens of Indianawho are appointed by the governor. Except as provided in subsection(c), a member:
        (1) may not be an officer or employee of a state educationalinstitution or a school corporation;
        (2) may not be a state employee;
        (3) may not be a member of the council; and
        (4) must be generally knowledgeable in the fields of business,industry, labor, agriculture, commerce, education, or career andtechnical education.
    (c) Notwithstanding subsection (b):
        (1) one (1) member must be a representative of the council ora private industry council;
        (2) one (1) member must be an officer or employee of a stateeducational institution; and
        (3) one (1) member must be an officer or employee of a schoolcorporation.
    (d) Each Indiana congressional district must be represented by atleast one (1) member who resides in that district.

Term; vacancies
    
Sec. 7. Appointments to the commission are for four (4) yearterms. The governor shall promptly make appointments to fillvacancies for the duration of unexpired terms in the same manner asthe original appointments.

Officers; commission member per diem and expenses
    
Sec. 8. (a) The commission shall elect from the commission'smembership a chairperson and vice chairperson and other necessaryofficers.
    (b) Each member of the commission is entitled to the minimumsalary per diem provided by IC 4-10-11-2.1(b). Each member is alsoentitled to reimbursement for traveling expenses and other expensesactually incurred in connection with the member's duties, as providedin the state travel policies and procedures established by the Indianadepartment of administration and approved by the budget agency.

Long range state plan; revision; distribution; contents
    
Sec. 9. (a) The commission shall develop and implement a longrange state plan for a comprehensive career and technical educationprogram in Indiana.
    (b) The plan developed under this section shall be kept current.The plan and any revisions made to the plan shall be made available

to:
        (1) the governor;
        (2) the general assembly;
        (3) the Indiana state board of education;
        (4) the department of education;
        (5) the commission for higher education;
        (6) the council;
        (7) the Indiana commission on proprietary education; and
        (8) any other appropriate state or federal agency.
A plan or revised plan submitted under this section to the generalassembly must be in an electronic format under IC 5-14-6.
    (c) The plan must set forth specific goals for public career andtechnical education at all levels and must include the following:
        (1) The preparation of each graduate for both employment andfurther education.
        (2) Accessibility of career and technical education toindividuals of all ages who desire to explore and learn foreconomic and personal growth.
        (3) Projected employment opportunities in various career andtechnical education fields.
        (4) A study of the supply of and the demand for a labor forceskilled in particular career and technical education areas.
        (5) A study of technological and economic change affectingIndiana.
        (6) An analysis of the private career and education sector inIndiana.
        (7) Recommendations for improvement in the state career andtechnical education program.
        (8) The educational levels expected of career and technicaleducation programs proposed to meet the projected employmentneeds.

Commission duties
    
Sec. 10. The commission shall do the following:
        (1) Make recommendations to the general assembly concerningthe development, duplication, and accessibility of employmenttraining and career and technical education on a regional andstatewide basis.
        (2) Consult with any state agency, commission, or organizationthat supervises or administers programs of career and technicaleducation concerning the coordination of career and technicaleducation, including the following:
            (A) The Indiana economic development corporation.
            (B) The council.
            (C) A private industry council (as defined in 29 U.S.C. 1501et seq.).
            (D) The department of labor.            (E) The Indiana commission on proprietary education.
            (F) The commission for higher education.
            (G) The Indiana state board of education.
        (3) Review and make recommendations concerning planssubmitted by the Indiana state board of education and thecommission for higher education. The commission may requestthe resubmission of plans or parts of plans that:
            (A) are not consistent with the long range state plan of thecommission;
            (B) are incompatible with other plans within the system; or
            (C) do not avoid duplication of existing services.
        (4) Report to the general assembly on the commission'sconclusions and recommendations concerning interagencycooperation, coordination, and articulation of career andtechnical education and employment training. A report underthis subdivision must be in an electronic format underIC 5-14-6.
        (5) Study and develop a plan concerning the transition betweensecondary level career and technical education andpostsecondary level career and technical education.
        (6) Enter into agreements with the federal government that maybe required as a condition of receiving federal funds under theVocational Education Act (20 U.S.C. 2301 et seq.). Anagreement entered into under this subdivision is subject to theapproval of the budget agency.

Commission powers
    
Sec. 11. The commission may do the following:
        (1) Make recommendations, including recommendations forpolicies to encourage involvement of minority groups in thecareer and technical education system in Indiana, to:
            (A) the governor;
            (B) the general assembly; and
            (C) the various agencies, commissions, or organizations thatadminister career and technical education programsconcerning all facets of career and technical educationprogramming.
        (2) Establish a regional planning and coordination system forcareer and technical education and employment training thatwill, either in whole or in part, serve career and technicaleducation and employment training in Indiana.
        (3) Appoint advisory committees whenever necessary.
        (4) Contract for services necessary to carry out this chapter.
        (5) Provide information and advice on career and technicaleducation to a business, an industry, or a labor organizationoperating a job training program in the private sector.

Implementation of programs; systems and policies
    
Sec. 12. The commission shall adopt statewide systems or policiesconcerning the following as the systems or policies relate to theimplementation of career and technical education programs:
        (1) Student records.
        (2) Data processing at the secondary level.
        (3) An evaluation system that must be conducted by thecommission at least annually and that evaluates the followingas each relates to the career and technical education programsand courses offered at the secondary level and postsecondarylevel:
            (A) Graduation rates.
            (B) Student placement rates.
            (C) Retention rates.
            (D) Enrollment.
            (E) Student transfer rates to postsecondary educationalinstitutions.
            (F) When applicable, student performance on state licensingexaminations or other external certification examinations.
            (G) Cost data study.
        (4) A system of financial audits to be conducted at leastbiennially at the secondary level.

Evaluation criteria
    
Sec. 13. (a) The commission shall establish career and technicaleducation evaluation criteria.
    (b) Using the criteria established under subsection (a), thecommission shall evaluate the effectiveness of career and technicaleducation relative to the goals of the long range plan developedunder section 9 of this chapter.

Federal funds for career and technical education; use of federalfunds subject to allocation by general assembly
    
Sec. 14. (a) Except as provided in subsection (c), the commissionshall receive, distribute, and maintain accountability for all federalfunds available for career and technical education under 20 U.S.C.2301 et seq.
    (b) Except as provided in subsection (c), the commission shalldistribute and maintain accountability for all federal funds availablefor career and technical education under 29 U.S.C. 1533.
    (c) The commission may not expend or distribute federal funds

available under 20 U.S.C. 2301 et seq. or 29 U.S.C. 1533 if thosefunds have not been allocated by the general assembly.

Legislative budget requests; review and recommendations
    
Sec. 15. (a) The department shall review the legislative budgetrequests for career and technical education prepared by thefollowing:
        (1) The department of education.
        (2) The state educational institutions.
    (b) After the review under subsection (a), the department shallmake recommendations to the budget committee concerning theappropriation of state funds and the allocation of federal funds forcareer and technical education, including federal funds availableunder 20 U.S.C. 2301 et seq. and 29 U.S.C. 1533. The department'srecommendations concerning appropriations and allocations forcareer and technical education by secondary schools and stateeducational institutions must specify:
        (1) the minimum funding levels required by 20 U.S.C. 2301 etseq. and 29 U.S.C. 1533;
        (2) the categories of expenditures and the distribution plan orformula for secondary schools; and
        (3) the categories of expenditures for each state educationalinstitution.
    (c) After reviewing the department's recommendations and eachagency's budget request, the budget committee shall makerecommendations to the general assembly for funding to implementcareer and technical education. The general assembly shall bienniallyappropriate state funds for career and technical education andallocate federal funds available under 20 U.S.C. 2301 et seq. and 29U.S.C. 1533 for career and technical education. At least sixty percent(60%) of the federal funds available under 20 U.S.C. 2301 et seq.shall be allocated to secondary level career and technical educationto implement the long range state plan developed under section 9 ofthis chapter.
    (d) The budget agency, with the advice of the department and thebudget committee, may augment or reduce an allocation of federalfunds made under subsection (c).

Commission staff
    
Sec. 16. The commission may employ any staff necessary toperform the duties imposed by this chapter and fix the compensationand terms of that employment, subject to approval by the budgetagency.

Rules
    
Sec. 17. The commission shall adopt rules under IC 4-22-2 tocarry out the duties imposed by this chapter.

Limitation on commission powers
    
Sec. 18. The commission has no power relating to themanagement, operation, or financing of any state institution oragency except those specifically set forth in this chapter.
