Chapter 3. Commissioner of the Department

Appointment; compensation
Sec. 1. (a) The governor shall appoint a commissioner of thedepartment. The commissioner serves at the pleasure of the governoras the chief administrative officer of the department.
(b) The governor shall fix the commissioner's salary.

Staff
Sec. 2. The commissioner may do the following:
(1) Employ staff necessary to perform the duties of thedepartment imposed by this article.
(2) Fix the compensation and terms of staff employment,subject to the approval of the budget agency.

Adoption of rules
Sec. 3. The commissioner shall adopt rules under IC 4-22-2necessary to implement this article.

Appropriation of additional funds
Sec. 4. Funds necessary to support the operating costs of thedepartment of workforce development beyond those approved andappropriated by the United States Congress or approved by federalagencies for the operation of the department and specificallyauthorized by other provisions of IC 22-4:
(1) must be specifically appropriated from the state general fundfor this purpose; and
(2) may not be derived from other state or federal funds directedfor unemployment insurance programs under IC 22-4, includingfunds under the Wagner-Peyser Act (29 U.S.C. 49 et seq.), anyother grants or funds that are passed through for job trainingprograms, the Carl D. Perkins Vocational and AppliedTechnology Act (20 U.S.C. 2301 et seq.), and any other grantor funds for career and technical education.
