Chapter 8.1. Enforcement by the Commission

Civil action filed by commission
Sec. 1. The commission may file a civil action for appropriaterelief if the commission has reasonable cause to believe that:
(1) a person is engaged in a pattern or practice of resistance tothe full enjoyment of any right granted by this article; or
(2) a person has been denied any right granted by this articleand that denial raises an issue of general public importance.
An action under this section may be filed in a circuit or superiorcourt located in the county in which the alleged pattern, practice, ordenial occurred.

Relief by court
Sec. 2. In an action filed under section 1 of this chapter, the courtmay do the following:
(1) Award preventive relief, including a permanent ortemporary injunction, restraining order, or other order againstthe person responsible for a violation of this article as necessaryto assure the full enjoyment of the rights granted by this article.
(2) Award other appropriate relief, including monetarydamages, reasonable attorney's fees, and court costs.
(3) To vindicate the public interest, assess a civil penaltyagainst the respondent in an amount that does not exceed thefollowing:
(A) Fifty thousand dollars ($50,000) for a first violation.
(B) One hundred thousand dollars ($100,000) for a secondor subsequent violation.

Intervention by aggrieved person or party to conciliationagreement
Sec. 3. A person may intervene in an action filed under section 1of this chapter if the person is:
(1) an aggrieved person to the discriminatory housing practice;or
(2) a party to a conciliation agreement concerning thediscriminatory housing practice.

Enforcement of subpoena by attorney general
Sec. 4. The attorney general, on behalf of the commission or otherparty at whose request a subpoena is issued under this chapter, mayenforce the subpoena in appropriate proceedings in the court in
which the action is filed.
