Chapter 11. Merger, Consolidation, and Use of AssumedCommon Names

Adoption of common names
Sec. 1. Whenever any boards of trustees or any number thereof,organized before August 17, 1855, under any general or special lawof this state for the purpose of establishing a high school, academy,college, or university, may desire to assume a common name, it shalland may be lawful for such board or boards, by resolution, to beentered upon its or their respective record or records, to adopt suchcommon name as shall be agreed upon.

Merger and consolidation of common stock or other evidence ofproperty
Sec. 2. Said boards of trustees shall have power and are herebyauthorized to merge and consolidate their stock or other means, intoone (1) common stock, whether the same shall consist of real estate,moneys, bonds, bills, notes, mortgages or other evidences of propertyor debts, upon such terms as may be mutually agreed upon.

Recording resolution causing change of name
Sec. 3. It shall be the duty of such boards of trustees to cause acopy of the resolutions changing their name and consolidating theirproperty, as above prescribed, to be recorded in the office of theclerk of the circuit court of the county in which such high school,academy, college or university may be located, and a duplicatethereof with the secretary of state.

Effect of change
Sec. 4. The change of name and the consolidation of property, asprovided in this chapter, shall not be so construed as to deprive suchboard or boards of trustees of any of the powers and franchisesgranted in the original act or acts of incorporation, or amendmentsthereto, nor shall any thing contained in this chapter be so construedas to prevent any such board or boards of trustees so changing theirname or names, for all the rights and liabilities which may haveaccrued previous to changing their name and consolidating theirproperty.
