Chapter 16. Architectural Salvage Material Dealers

Applicability of chapter
Sec. 1. This chapter does not apply to the purchase of valuablemetal (as defined in IC 25-37.5-1-1(a)) by a valuable metal dealerregulated under IC 25-37.5.

"Architectural salvage material"
Sec. 2. (a) As used in this chapter, "architectural salvage material"means an item originally installed on or in a dwelling, a business, orany other structure and subsequently removed from the dwelling,business, or other structure.
(b) The term includes the following:
(1) Aluminum, wood, or vinyl siding.
(2) Balustrades or other stair parts.
(3) Bathroom or kitchen cabinets or fixtures.
(4) Doors, door architraves, or doorknobs.
(5) Light fixtures.
(6) Mantelpieces.
(7) Plumbing.
(8) Shutters.
(9) Windows and window architraves, including stained glassor leaded glass window panes.
(10) Wood trim.

"Dealer"
Sec. 3. As used in this chapter, "dealer" means a person whopurchases or otherwise acquires architectural salvage material forresale or reuse as part of the normal course of the person's business.

Transfer of ownership; identification
Sec. 4. Before a person may sell or otherwise transfer ownershipof architectural salvage material to a dealer, the person must presentgovernment issued identification to the dealer to verify the identityof the person.

Dealer restrictions
Sec. 5. A dealer may not purchase or otherwise obtainarchitectural salvage material:
(1) from a person who is less than eighteen (18) years of age; or (2) that the dealer believes or should have reason to believe isstolen property acquired as a result of a crime.

Dealer records; inspection
Sec. 6. (a) A dealer shall keep a record book that contains thefollowing information concerning architectural salvage materialreceived by the dealer:
(1) An accurate description of any architectural salvage materialreceived by the dealer. If multiple articles of a similar naturethat do not contain an identification or serial number aredelivered together in one (1) transaction to the dealer, thedescription of the articles is adequate if the descriptioncontains:
(A) the quantity of the articles delivered; and
(B) a physical description of the type of articles delivered,including any unique identifying marks, numbers, names,letters, or special features.
(2) The date and time of the transaction.
(3) The:
(A) name, address, date of birth, and telephone number; and
(B) signature;
of the person who sold or otherwise transferred ownership ofthe architectural salvage material to the dealer.
(4) The:
(A) type of government issued identification used to verifythe identity of the person who sold or otherwise transferredownership of the architectural salvage material to the dealeras described in section 4 of this chapter;
(B) name of the governmental agency that issued theidentification; and
(C) identification number printed on the government issuedidentification.
(b) The record book described in subsection (a) must be open toinspection by a law enforcement officer at all reasonable times.
(c) A dealer shall retain a record book described in subsection (a)for at least two (2) years after the date of the most recent transactionrecorded in the book.

Dealer duty to hold architectural salvage material
Sec. 7. If a dealer receives a notice from a law enforcementagency to hold architectural salvage material possessed by the dealer,the dealer shall hold the architectural salvage material for at leastfive (5) business days after the date the dealer receives the notice.

IC 24-4-16-8 Confidentiality of dealer records and other information
Sec. 8. (a) Records and information generated by a dealerconcerning architectural salvage material are confidential underIC 5-14-3-4.
(b) A law enforcement officer may obtain or receive records andinformation described in subsection (a) for use in the official lawenforcement purpose of investigating crime.
(c) A law enforcement officer may disclose the name and addressof a dealer to an adverse claimant in the case of a dispute overownership of architectural salvage material in possession of thedealer.

Violations; penalties
Sec. 9. A person who violates this chapter commits a Class Ainfraction.
