    Chapter 8. Prohibition on Direct Molding Process

"Direct molding process" defined
    Sec. 1. As used in this chapter, "direct molding process" meansany process by which a manufactured watercraft or its componentpart is used as a plug for the making of a mold from which aduplicate of the watercraft or component is made.

"Mold" defined
    Sec. 2. As used in this chapter, "mold" means any pattern, hollowform, matrix, or other device for giving shape or form to material ina plastic or molten state.

"Plug" defined
    Sec. 3. As used in this chapter, "plug" means a manufactured itemused to make a mold.

"Watercraft" defined
    Sec. 4. As used in this chapter, "watercraft" means anyinstrumentality or device in or by means of which a person may betransported upon waters and includes a motorboat, sailboat, rowboat,skiff, dinghy, or canoe of whatever length or size.

Acts prohibited
    Sec. 5. (a) A person may not manufacture, by use of a directmolding process, a watercraft or its component part manufactured byanother person without permission of that other person.
    (b) A person may not sell a watercraft or its component partmanufactured in violation of subsection (a).

Civil action for injunctive relief or damages
    Sec. 6. (a) A person injured by a violation of section 5 of thischapter may bring a civil action for:
        (1) injunctive relief;
        (2) actual damages caused by the violation;
        (3) treble damages; and
        (4) costs and reasonable attorney's fees.
    (b) Injunctive relief may be granted for a violation of section 5 of

this chapter regardless of the failure of the plaintiff to showirreparable injury.

Application of chapter
    Sec. 7. This chapter applies to products duplicated using a moldmade after August 31, 1987.
