    Chapter 18. Garage Door Opening Systems

"Automatic garage door opening system"
    
Sec. 1. As used in this chapter, "automatic garage door openingsystem" means a system of devices and equipment that is not acommercial garage door operator and that when connected to agarage door automatically opens and closes the garage door.

"Automatic reversing requirement"
    
Sec. 2. As used in this chapter, "automatic reversing requirement"refers to the requirements specified in paragraphs 30.1 and 30.2 ofUnderwriters Laboratories, Inc., Standards for Safety-UL 325, thirdedition, as revised May 4, 1988, for an automatic garage dooropening system.

"Garage"
    
Sec. 3. As used in this chapter, "garage" means a building or apart of a building designed or used for the storage, repair, or keepingof a motor vehicle.

"Person"
    
Sec. 4. As used in this chapter, "person" means an individual, acorporation, a partnership, an association, or other legal entity.

"Residential building"
    
Sec. 5. As used in this chapter, "residential building" means astructure such as a home or an apartment for one (1) or more familiesor persons that includes an attached or unattached garage.

"Supplier"
    
Sec. 6. As used in this chapter, "supplier" means a seller, lessor,assignor, or other person who regularly engages in or solicitsconsumer transactions.

Repair or installation without onsite reversal test forbidden;exceptions    Sec. 7. (a) A supplier may not:
        (1) repair; or
        (2) install;
an automatic garage door opening system in a residential buildingunless the system passes the onsite test described in section 8 of thischapter.
    (b) This section does not prevent the servicing or repair of anautomatic garage door opening system if, after the repair or service:
        (1) the system complies with subsection (a); or
        (2) the supplier complies with section 8 of this chapter.

Onsite reversal test procedure; warning tag; notice
    
Sec. 8. (a) A supplier who installs, services, or repairs anautomatic garage door opening system in a residential building shallconduct an onsite reversal test of the system. In order to pass theonsite reversal test, the system must reverse the door upon contactwith a rigid two inch (2") high obstacle (or a 2 by 4 block of wood)placed on the surface beneath the garage door.
    (b) If the automatic garage door opening system does not pass theonsite reversal test required by subsection (a), the supplierconducting the test shall complete and conspicuously attach to theautomatic garage door opening system a label or tag that contains thefollowing information (The following language complies with thisrequirement, but other language may be used that conveys theequivalent information.):

WARNING


This garage door opener was tested and does not meet the currentrequirements for a working safety reverse feature. This can bedangerous and may cause serious injury or death. You are advised todisconnect the opener from the door immediately and operate thedoor manually until the opener has been repaired or replaced with anopener that meets current safety standards relating to automaticreversal.

    (c) The word "WARNING" on the label or tag described insubsection (b) shall be in the foreground and background colors that

comply with the standards of the American National StandardsInstitute (ANSI) that are in effect at the time that the label or tag isaffixed.
    (d) The employer of the person who attaches a label or tag undersubsection (b) shall notify the occupant of the residence within ten(10) working days in writing that the residence's automatic garagedoor opening system does not comply with this chapter.

Local ordinance
    
Sec. 9. This chapter does not preclude a political subdivision fromadopting, by ordinance, rules for the installation and repair ofautomatic garage door opening systems that are more restrictive thanthe standards set forth in this chapter.

Violations; penalty
    
Sec. 10. (a) A supplier who knowingly violates the requirementsof this chapter is subject to a civil penalty of five hundred dollars($500) for each violation.
    (b) The attorney general may bring an action on behalf of the stateto recover the penalty imposed by subsection (a) from the supplier.
