    Chapter 6. Expiration of Licenses; Renewal of Licenses;Continuing Education

Time of expiration
    
Sec. 1. (a) Except as provided in subsection (b), a license issuedunder this article expires on the date established by the licensingagency under IC 25-1-6-4.
    (b) A funeral director intern license expires two (2) years after itis issued by the board.

Funeral homes; renewal of licenses
    
Sec. 2. The board shall renew the license of a funeral homelicensee that pays the registration fee set by the board.

Funeral directors or embalmers; renewal of licenses
    
Sec. 3. The board shall renew the license of a funeral director orembalmer who:
        (1) pays the fee; and
        (2) meets the continuing education requirements;
set by the board.

Funeral directors or embalmers; reinstatement of expired license
    
Sec. 4. (a) The board shall reinstate the expired license of:
        (1) a funeral director;
        (2) an embalmer;
        (3) a funeral director intern; or
        (4) a funeral home;
that applies for reinstatement of the license not later than three (3)years after the date the license expired and meets the requirementsfor reinstatement under IC 25-1-8-6(c).
    (b) If the license of:
        (1) a funeral director;
        (2) an embalmer;
        (3) a funeral director intern; or
        (4) a funeral home;
has been expired for more than three (3) years, the board shallreinstate the license if the holder of the license applies forreinstatement of the license and meets the requirements forreinstatement under IC 25-1-8-6(d).

Funeral directors; continuing education credits
    
Sec. 5. (a) The board shall require a funeral director to obtain ten(10) hours of continuing education credit in any two (2) year periodin order to renew or reinstate a license under this chapter. The boardshall require that continuing education credit be earned in boardapproved courses or programs on one (1) or more of the followingsubjects:
        (1) Embalming and restorative arts.
        (2) Prevention of the spread of infectious disease andcompliance with mandatory public health requirements.
        (3) Federal and state laws and rules regulating the embalmingand funeral professions.
        (4) Funeral home management.
        (5) Religion.
        (6) Natural science.
        (7) Grief counseling and the psychological effect of death onsurvivors.
    (b) Continuing education hours earned as a prerequisite to theissuance or maintenance of a professional license other than a funeraldirector license may not be counted in determining compliance withthis section.

Revocation, suspension, or expiration of funeral home and branchlocation license
    
Sec. 5.1. When a person's funeral home license is revoked,suspended, or expired, the person's branch location license that arisesfrom that funeral home license is revoked, suspended, or expired.

Inactive license continuing education exemption; reactivationrequirements; practice under inactive license; sanction
    
Sec. 7. (a) A funeral director who holds an inactive funeraldirector license under IC 25-15-4-6 is exempt from continuingeducation requirements of section 5 of this chapter.
    (b) An individual may reactivate an inactive funeral director'slicense by completing all hours of continuing education required oflicensed funeral directors for each year that the license has beenclassified as inactive. If an individual's license has been inactive forfour (4) or more years, the board shall require the individual to passan examination under IC 25-15-4 before reinstating the individual'slicense to active status.    (c) An individual who resumes the practice of funeral service orthe provision of funeral services to the public under an inactivefuneral director license (as described in IC 25-15-4-6) violates thisarticle and the board shall revoke the individual's inactive license.
