Application of article; exclusions
Sec. 1. (a) This article applies to an individual who conductshome inspections for compensation.
(b) This article does not apply to the following:
(1) An individual who is acting within the scope of theindividual's employment as:
(A) a code enforcement official for the state or a politicalsubdivision of the state; or
(B) a representative of a state or local housing agency orauthority acting under the authority of the United StatesDepartment of Housing and Urban Development.
(2) An individual who is:
(A) either:
(i) registered as an architect under IC 25-4;
(ii) registered as a professional engineer under IC 25-31;or
(iii) licensed as a plumbing contractor or journeymanplumber under IC 25-28.5; and
(B) acting within the scope of the individual's registration orlicense.
(3) An individual who is licensed under IC 25-34.1 as a realestate broker, broker-salesperson, or salesperson and is actingwithin the scope of the individual's license.
(4) An individual who is licensed or certified under IC 25-34.1as a real estate appraiser and is acting within the scope of theindividual's license or certificate.
(5) An individual who holds a certificate of authority underIC 27-1-27-2 as a public adjuster and is acting within the scopeof the individual's certificate.
(6) An individual who holds a permit, certificate, or license to:
(A) use and apply pesticides; or
(B) make diagnostic inspections and reports for wooddestroying pests;
under IC 15-16-5 and is acting within the scope of theindividual's certificate or license.
(7) An individual who holds a license from a politicalsubdivision as a tradesperson or home builder and is actingwithin the scope of the individual's license.
