    Chapter 8. Renewal of Certificates

Expiration of certificates
    Sec. 1. (a) A certificate of registration expires biennially on thedate established by the licensing agency under IC 25-1-6-4.
    (b) An individual may renew a certificate of registration by payinga renewal fee on or before the expiration date established by thelicensing agency.
    (c) If an individual fails to pay a renewal fee on or before theexpiration date of a certificate of registration, the certificate ofregistration becomes invalid without any action of the board.
    (d) A certificate of registration may be reinstated by the board notlater than three (3) years after its expiration if the applicant forreinstatement meets the requirements for reinstatement underIC 25-1-8-6(c).
    (e) If a certificate of registration has been expired for more thanthree (3) years, the certificate of registration may be reinstated by theboard if the holder meets the requirements for reinstatement underIC 25-1-8-6(d).

    Sec. 2. The biennial period for renewals extends from August 1of an even-numbered year to July 31 of the next even-numbered year.

Renewal notices; procedure for paying fees
    Sec. 4. (a) Renewal notices must be sent in accordance withIC 25-1-2-6(c).
    (b) The renewal fees must be paid in accordance withIC 25-1-8-2(d).

    Sec. 6. Except as provided in IC 25-21.5-3-4(b), the board shallestablish fees under IC 25-1-8.As added by P.L.23-1991, SEC.12. Amended by P.L.194-2005,SEC.64; P.L.177-2006, SEC.5.

Continuing education
    Sec. 7. (a) The board may adopt rules requiring a land surveyor toobtain continuing education for renewal of a certificate under thischapter.
    (b) If the board adopts rules under this section, the rules mustestablish procedures for approving an organization that providescontinuing education.
    (c) If the board adopts rules under this section, the board mayadopt rules to do the following:
        (1) Allow private organizations to implement the continuingeducation requirement.
        (2) Establish an inactive certificate of registration. If the boardadopts rules establishing an inactive certificate, the board mustadopt rules that:
            (A) do not require the holder of an inactive certificate toobtain continuing education;
            (B) prohibit the holder of an inactive certificate frompracticing land surveying;
            (C) establish requirements for reactivation of an inactivecertificate; and
            (D) do not require the holder of an inactive certificate to paythe registration and renewal fees required underIC 25-21.5-7-5.
