    Chapter 2. Creation of Medical Licensing Board

Creation and membership
    
Sec. 1. The medical licensing board of Indiana is created. It shallconsist of seven (7) members, not more than four (4) of whom shallbe members of the same political party. The members shall beappointed by the governor, and all vacancies occurring on the boardshall be filled by the governor. The membership of the board shallconsist of the following:
        (1) Five (5) reputable physicians who:
            (A) are graduates of a medical school;
            (B) hold the degree of doctor of medicine or its equivalent;and
            (C) hold valid unlimited licenses to practice medicine inIndiana;
        shall serve for terms of four (4) years each.
        (2) One (1) reputable osteopathic physician who:
            (A) is a graduate of an accredited osteopathic medicalschool;
            (B) holds the degree of doctor of osteopathy or itsequivalent; and
            (C) holds a valid unlimited license to practice osteopathicmedicine in Indiana;
        shall serve for a term of four (4) years.
        (3) One (1) member to serve a term of four (4) years who:
            (A) will represent the general public;
            (B) is a resident of this state; and
            (C) is in no way associated with the medical profession otherthan as a consumer.

Meetings and election of officers; quorum
    
Sec. 2. The board shall have regular meetings called upon therequest of the president or a majority of the board for the transactionof business as may properly come before it under this article. At thefirst meeting of the board in each calendar year, the board shallorganize by the election of a president and any other officersconsidered necessary by the board. Four (4) members of the boardconstitute a quorum. A majority of the quorum may transactbusiness.

Per diem and expenses
    
Sec. 3. Per Diem and Expenses. For their services, the members

shall receive the per diem as is generally paid to similar boards andagencies of the state, and the traveling expenses necessarily incurredin their attendance upon the business of the board.

Record keeping
    
Sec. 4. The agency shall keep a record of all licenses, permits, andapplications for licensure or permit. This record must contain all thefacts set forth in the application, including the action of the boardthereon.

Registration and penalty fees; funds; disposition; expenses ofboard
    
Sec. 5. The funds obtained from registration and penalty feesshall, upon receipt thereof, be accounted for and paid over by theagency to the treasurer of state and be placed in the general fund ofthe state. The expenses of the board shall be paid from the generalfund upon appropriation being made therefor in the manner requiredby law for the making of such appropriations. The amount to beexpended by the board shall not exceed the amount collected by theboard from all sources.

Powers and duties
    
Sec. 7. (a) The board shall do the following:
        (1) Adopt rules and forms necessary to implement this articlethat concern, but are not limited to, the following areas:
            (A) Qualification by education, residence, citizenship,training, and character for admission to an examination forlicensure or by endorsement for licensure.
            (B) The examination for licensure.
            (C) The license or permit.
            (D) Fees for examination, permit, licensure, and registration.
            (E) Reinstatement of licenses and permits.
            (F) Payment of costs in disciplinary proceedings conductedby the board.
        (2) Administer oaths in matters relating to the discharge of itsofficial duties.
        (3) Enforce this article and assign to the personnel of the agencyduties as may be necessary in the discharge of the board's duty.        (4) Maintain, through the agency, full and complete records ofall applicants for licensure or permit and of all licenses andpermits issued.
        (5) Make available, upon request, the complete schedule ofminimum requirements for licensure or permit.
        (6) Issue, at the board's discretion, a temporary permit to anapplicant for the interim from the date of application until thenext regular meeting of the board.
        (7) Issue an unlimited license, a limited license, or a temporarymedical permit, depending upon the qualifications of theapplicant, to any applicant who successfully fulfills all of therequirements of this article.
        (8) Adopt rules establishing standards for the competentpractice of medicine, osteopathic medicine, or any other formof practice regulated by a limited license or permit issued underthis article.
        (9) Adopt rules regarding the appropriate prescribing ofSchedule III or Schedule IV controlled substances for thepurpose of weight reduction or to control obesity.
        (10) Adopt rules establishing standards for office basedprocedures that require moderate sedation, deep sedation, orgeneral anesthesia.
    (b) The board may adopt rules that establish:
        (1) certification requirements for child death pathologists;
        (2) an annual training program for child death pathologistsunder IC 16-35-7-3(b)(2); and
        (3) a process to certify a qualified child death pathologist.
