    Chapter 2. Definitions

Applicability of definitions
    
Sec. 1. The definitions in this chapter apply throughout thisarticle.

"Adverse action"
    
Sec. 2. "Adverse action" means a home or remote state action.

"Alternative program"
    
Sec. 3. "Alternative program" means a voluntary, nondisciplinarymonitoring program approved by a nurse licensing board.

"Board"
    
Sec. 4. "Board" has the meaning set forth in IC 25-23-1-1.

IC 25-23.3-2-5
"Coordinated licensure information system"
    
Sec. 5. "Coordinated licensure information system" means anintegrated process:
        (1) for collecting, storing, and sharing information on nurselicensure and enforcement activities related to nurse licensurelaws; and
        (2) administered by a nonprofit organization composed of andcontrolled by state nurse licensing boards.

"Home state"
    
Sec. 6. "Home state" means the party state that is a nurse'sprimary state of residence.

"Home state action"
    
Sec. 7. "Home state action" means any administrative, civil,equitable, or criminal action permitted by the home state's laws thatare imposed on a nurse by the home state's licensing board, includingan action against an individual's license, such as revocation,suspension, probation, or any other action that affects a nurse'sauthorization to practice.As added by P.L.134-2008, SEC.34.

"Licensing board"
    
Sec. 8. "Licensing board" means a party state's regulatory bodyresponsible for issuing nurse licenses.

"Multistate licensure privilege"
    
Sec. 9. "Multistate licensure privilege" means current, officialauthority from a remote state permitting the practice of nursing aseither a registered nurse or a licensed practical/vocational nurse inthat party state. All party states have the authority, in accordancewith state due process law, to take actions against a nurse's privilege,such as revocation, suspension, probation, or any other action thataffects a nurse's authorization to practice.

"Nurse"
    
Sec. 10. "Nurse" means a registered nurse or licensedpractical/vocational nurse as defined by the state practice laws ofeach party state.

"Party state"
    
Sec. 11. "Party state" means any state that has adopted thiscompact.

"Remote state"
    
Sec. 12. "Remote state" means a party state, other than the homestate:
        (1) where a patient is located at the time nursing care isprovided; or
        (2) in the case of the practice of nursing not involving a patient,in a party state where the recipient of nursing practice islocated.

"Remote state action"
    
Sec. 13. "Remote state action" means:
        (1) any administrative, civil, equitable, or criminal actionpermitted by a remote state's laws that are imposed on a nurseby the remote state's licensing board or other authority,including actions against an individual's multistate licensure

privilege to practice in the remote state; and
        (2) cease and desist and other injunctive or equitable ordersissued by remote states or the licensing boards of remote states.

"State"
    
Sec. 14. "State" means a state, territory, or possession of theUnited States, the District of Columbia, or the Commonwealth ofPuerto Rico.

"State practice laws"
    
Sec. 15. "State practice laws" means the individual party state'slaws and rules that govern the practice of nursing, define the scopeof nursing practice, and create the methods and grounds for imposingdiscipline. The term does not include the initial qualifications forlicensure or requirements necessary to obtain and retain a license,except for qualifications or requirements of the home state.
